Néanmoins, dans les faits, seuls les services audiovisuels ont été explicitement exclus du mandat de négociation. Les autres services culturels, notamment les arts du spectacle, tombent eux dans le champ de portée du traité, conformément à l’Accord général sur le commerce des services (AGCS). Alors que la plus grande partie du débat public tend à assimiler l’exclusion des services audiovisuels du mandat de négociation à une « exception culturelle » plus large, il ne s’agit pas d’une représentation exacte.
