[12] By-law No. 210, Sch. B, contains the zoning charts for the municipality.  These charts authorize certain uses in each zone.  A party may apply for a permit wherever a particular use is authorized.  Initially, the zoning chart contained no box for “water aerodromes” or “aeronautics”.  The parties to the present appeal agree that in light of this silence, the by-law was interpreted to permit water aerodromes by analogy to other approved uses. The Attorney General of Quebec presents this interpretation in paras. 11 and 39 of its factum.  Moreover, the parties argued this appeal on the basis of their shared understanding that by‑law No. 210 did not prohibit the landing and taking off of hydroplanes at the relevant location and that the amendment brought about by by‑law No. 260[3] was necessary to achieve that result.  This shared understanding is reflected in both their written and oral submissions in this Court.  While the proper interpretation of the provisions is debatable, the parties’ shared understanding of the interpretation is plausible and I do not think the Court should approach the case on a basis that does not reflect that shared understanding on which all of  the submissions of the parties were formulated.

Mount Royal arrived at the decision following careful study of the Act respecting Land Use Planning and Development. The fourth point of Article 130 foresees that in the particular case of a By-law provision modifying the classification of the construction or the uses permitted in a zone, a request aimed at having the By-law submitted for approval by the people entitled to vote may come from all contiguous zones as long as a request comes from the zone concerned.

In 2006, ÖSW was selected through this developers competition to develop the Europan project and the team started a new stage developing ÖSW ideas together with their own ideas in a really tough process in which the architects overcame a lot of different situations. Continuous changes threatened the project during this endless phase, involving main uses variations as a hotel, a temporary houses zone, a cellars area, a huge supermarket, a 300 employees enterprise, a 2-level youth hostel, a ground floor car park, a central park, etc.

En 2006 l’aménageur ÖSW a été sélectionné via ce concours de développeurs pour réaliser le projet Europan et l’équipe a alors débuté une nouvelle phase de développement mettant en commun les idées d’ÖSW et les leurs. Cette phase du processus s’est avérée difficile durant laquelle les architectes ont dû faire face à de nombreux changements mettant en péril la réalisation du projet. Ces modifications impliquaient une variation des usages principaux comme un hôtel, une zone de logements temporaires, une zone de celliers, un grand supermarché, une entreprise de 300 employés, une auberge de jeunesse sur 2 niveaux, un parking en rez-de-chaussée, un parc central, etc.
