This unique Roman mining heritage and the outstanding mining landscape and architecture of Roşia Montană have been under serious threat by the proposed opencast mining activity. Now however, as a result of the remarkable determination displayed by tens of thousands of Romanian citizens and indeed citizens of many other countries both in Europe and elsewhere, and as a result of the recent vote by the two chambers of the Romanian Parliament, the time has come to investigate and propose a social, economic and environmental development plan based on the promotion and valorisation of Roşia Montană's unique assets.

This total subordination of Government politics to the interest and profit of the mining company leads to serious offences such as violating the fundamental interest of the nation and annulling the sovereignty of the legal system. Although this is a private investition, this project is declared to be one of 'special public national interest' (Art.1) - so that any person opposing it can be expropriated (Art. 62). RMGC can become the owner of any public building within 45 days after formally requesting this - without any auction (pt. 7 of Art.4). Also, if any document or permit obtained by the company is annuled in a court of law the state authorities are obliged to emit it again within 30 days (pt. 9, letter A of Art. 4). The owner of the mining licence can re-locate natural monuments within the exploitation perimeter in order to 'protect' them (pt. 4 of Art. 5).

The special law whose scope is to declare the Rosia Montana mine as one of national interest includes provisions that violate the country's constitution. It also violates the principle of the separation of powers, human rights and it violates the judicature's sovereignty. If the special bill is approved, the Rosia Montana project owner, will be able to directly expropriate owners of any construction or land and is freed from having to obtain any of the still outstanding permits.

Both prime minister Ponta and president Băsescu lobby in favour of Roșia Montană Gold Corporation as long as both continue to ignore the core issue – the project is incompatible with the rule of law. Themes such as the jobs creation or the use of cyanide in the eventuality that the project would start obscure two main reasons for which the project cannot be carried out. The project footprint, including the location of the processing plant, and that of the tailing pond overlap properties belonging to locals who do not want to leave. Furthermore, Roșia Montană houses a cultural heritage which is unique in the world, belonging to current but also future generations. Topics such as the heritage did not find their way in Mr. Băsescu’s statements, although he appointed a Presidential Commission for Patrimony in 2009, whose report, very ferm with regards to Roșia Montană, was ignored.

In the case of Certej project the article shows the key persons involved in the sale, by a private person to another private person, of the mineral deposit originally held by the Romanian state, with no revenue for the state budget. The row of supporters also includes other people from Hunedoara, including public officers in the local environmental protection agency. All this information is given in the context of the lack of a mineral resource policy adapted to our times. This generates a source of corruption and social disintegration, showing a bitter X-ray of the deep corruption of Romanian society.

6 februarie este data primei atestări documentare a anticului Alburnus Maior, Roșia Montană de astăzi. După 1885 de ani, satului din Apuseni i se recunoaște adevăratul potențial. “Îi invităm pe toți cei care au fost alături de Roșia Montană și Alburnus Maior în toți acești ani să participe la evenimentele dedicate Zilei Roșiei Montane și să contribuie la construirea unei noi viziuni pentru dezvoltarea durabilă a localității. Voi fi prezent la București, împreună cu câteva zeci de localnici din Roșia Montană și Câmpeni, pe 6 februarie, alături de toți cei ce știu să lupte și să sărbătorească ceea ce merită cu adevărat apărat!” – Eugen David, președintele Asociației Alburnus Maior.

In 2009 the ARA Association, an NGO specialising on architecture, restoration and archaeology submitted a detailed proposal for Roşia Montană to be included on the country's Tentative List of UNESCO[2] World Hertitage sites. The request was ignored by 10 ministers of culture, while on the other hand priority was given to plans to turn the town into Europe's largest open cast cyanide-based gold mine. All the while the proposal to include the site to the Tentative List enjoyed strong support from the national and international scientific community; including the country's Commission for Historical Monuments. From a technical point of view, the act of adding Roşia Montană to the country's list of tentative UNESCO sites was set in stone through the Minister of Culture's signature.

“Argumentele aduse în sprijinul cererii de strămutare nu au avut niciun suport probator și s-au rezumat la simple afirmații vizând pretinsa părtinire a magistraților Tribunalului Cluj. În întreaga lor activitate de atacare în instanță a unor acte ilegale emise pentru autorizarea proiectului Roșia Montană cele două asociații au avut o practică permanentă de a nu dezvălui niciun fel de informații privind procedurile judiciare în curs tocmai pentru a nu exista niciun fel de suspiciune de presiune publică asupra magistraților investiți cu soluționarea cauzelor. Toate comunicările au vizat strict hotărârile definitive și irevocabile pronunțate în cauze, așadar deliberarea judecătorilor nu a fost niciodată influențată de dezbaterile publice contra proiectului minier. În condițiile în care proteste publice contra proiectului minier au loc în cvasi-majoritatea orașelor mari din țară și sute de mii de persoane din întreaga țară și-au exprimat prin petiții și proteste opinia în privința proiectului, ne întrebăm dacă în logica îmbrățișată de ICCJ vreo instanță națională ar mai fi imparțială în judecarea cauzelor respective”, a declarat Ștefania Simion, consilierul juridic al ONG-urilor reclamante.

“The arguments brought in support of the requests to transfer the files lacked any evidence and were subjective statements on the alleged bias showed by magistrates at the Cluj Tribunal. During their entire litigation activity concerning illegal acts issued for the gold mining project at Rosia Montana the two NGOs have had a constant practice not to disclose information regarding the ongoing judicial procedures in order to preclude any suspicion of public pressure on the magistrates in charge of hearing the cases. All public statements made by the plaintiffs strictly referred to definitive and irrevocable judgments in the trials, therefore the magistrates’ deliberation has never been influenced by public debates against the mining project. Witnessing massive public protests in virtually all major towns of Romania and internationally and given that hundred thousands of people expressed themselves through protests and petitions against the mining project, we wonder if in HCCJ’s logic any national court would be impartial to hear our cases”, declared Stefania Simion, the NGO’s legal representative.

, pending at the Court in Covasna, file number 8318/117/2011. The suspension of the same permit is required in the file 740/117/2012, pending at the Court in Bacau. The environmental permit is compulsory for the regional urban plan to be approved in the perimeter of industrial development proposed by Rosia Montana Gold Corporation. This plan has not yet been subject to the approval of the Local Council in Rosia Montana. The environmental permit conflicts with the present legislation, since it was issued for an area which is archaeologically protected and included in a programme of ecological rehabilitation financed from governmental funds. Moreover, the judicial audit which you requested in your previous mandate recommends the ceasing of Rosia Montana mining project analysis, following the final decision of the Court of Appeal Alba Iulia, decision which annuls the Decision of Rosia Montana Local Council no.1/2009, confirming the initial urban plans, voted in 2002. Along these lines, we invite you to make public this audit, following, thus, the criteria of transparency concerning the studies paid from public resources.

O intrebare legitimă care se ridică dacă ar fi să acceptăm logica intervenientului dar și a ICCJ care a admis cererile sale ar fi în ce masură asemenea cereri au putut fi judecate imparțial la București în condițiile în care cele mai ample proteste publice contra proiectului Roșia Montană au loc la București, dar și văzând poziția Președintelui României și a Domnului Victor Ponta al cărui Guvern este pentru exploatarea de la Roșia Montană.

One legitimate question to ask if we were to embrace RMGC and HCCJ’s reasoning is to what extent these requests could have been impartially decided on in Bucharest given that actually the country’s largest public protests against the Rosia Montana project take place in Bucharest, but also considering the position expressed by the country’s President and by Mr. Victor Ponta, President of the Social Democratic Party and who’s Government is a vehement supporter of the Rosia Montana gold mining project.

15. April 2014 - One of the crucial permits necessary for further continuation of the approval procedure for the cyanide mining project in Rosia Montana has been anulled by court today. The Sibiu Regional Environmental Protection Agency's decision (REPA ) had issued an environmental permit for the "Modified Zoning Plan for the Industrial Development Area of RMGC" that is, as of today, not valid anymore.
