The new contracts enable ASTRA satellite households in Germany to continue to receive the variety of public TV and radio programmes direct-to-home and allow for a nation-wide, ubiquitous switch-over from analogue to digital satellite transmissions. The agreements therefore reflect the German Federal Government’s media policy target of discontinuing analogue TV distribution by 2010, if market conditions allow. The new long-term contracts cover analogue and digital satellite distribution via ASTRA’s prime orbital position of 19.2° East for virtually all of Germany’s public TV and radio programmes.

Lorsque les radiodiffuseurs songent à inclure ces productions dans le programme de chaînes spécialisées ou à les offrir dans des services à la demande, ils ne tardent pas à s'apercevoir qu'au moment de la production, il y a des années, ils n'ont pas acquis (ou ne le pouvaient pas en raison de la législation en vigueur) les droits nécessaires pour utiliser ces productions dans des services à la demande (type d'utilisation encore inconnu à l'époque), ou alors qu'ils étaient naguère convenus de suppléments pour des rediffusions, d'un montant qui serait totalement disproportionné dans le contexte d'une chaîne spécialisée n'attirant qu'un pourcentage minime de l'audience nationale.

When broadcasters consider the prospect of including these productions in specialized programme channels or of offering them in on-demand services, they all too soon discover that at the time of production many years ago they either did not (or even could not under the applicable law) acquire the necessary rights for the then unknown use in on-demand services or they had agreed on supplements for rebroadcasts which would be totally disproportionate in the context of a specialized channel attracting only a minimal share of the national audience. They also discover that, subject to a few exceptions (in particular musical petits droits works), any renegotiation of an appropriate level of remuneration for the rebroadcast and acquisition of the necessary rights for use not envisaged under the original production agreements is either impossible, since individual rightowners or their heirs cannot be identified or traced, or would be totally disproportionate to the intended use.

Un dernier aspect à considérer, car il est essentiel, est que si le règlement des droits est impossible, ou ne mérite pas qu'on fasse l'effort, le premier à en pâtir est certes le public (privé du plaisir d'accéder à son patrimoine audiovisuel), mais les ayants droit en subissent également les conséquences: aucun d'eux ne touchera une rémunération si un seul (parmi tous ceux qui ont contribué à la production, et ils peuvent être fort nombreux) n'a pu être identifié, ou refuse d'entrer en matière pour conclure un accord.

Finally, the bottom line to be kept in mind is that where rights clearance is not possible, or not worth the effort, it is not only the public that will suffer (by not being able to enjoy access to its audiovisual heritage); so too will the rightholders, since no rightholder will receive any remuneration if even a single one of them (out of a potentially large number of contributors to the production) cannot be identified, or refuses to enter into an agreement.
