Si vous n’avez pas passé cet examen, l’IPI a besoin de la décision de la commission d’examen sur la reconnaissance de l’examen étranger de conseil en brevets et, le cas échéant, de la réussite de l’examen de qualification (art. 31, al. 1, let. b, ch. 2, OCBr).

In order to be registered in the Swiss Federal Patent Attorney Register, we need the certificate issued by the Examination Board stating that you passed the Swiss Federal Patent Attorney Examination (Art. 31 para. 1 let. b No. 1 PatAO). If you have not taken this examination, we need the official decision regarding recognition of your foreign patent attorney examination from the Examination Commission, and if applicable, of the passing of a qualifying examination (Art. 31 para. 1 letter b No. 2 PatAO). Should the documentation you submit be incomplete or if there is doubt regarding its accuracy, the IPI may request additional information or proof under Art. 31 para. 3 PatAO.

Für die Eintragung in das Patentanwaltsregister brauchen wir von Ihnen die Bescheinigung der Prüfungskammer über das Bestehen der eidgenössischen Patentanwaltsprüfung (Art. 31 Abs. 1 Bst. b Ziff. 1 PAV). Sofern Sie diese Prüfung nicht abgelegt haben, benötigen wir von Ihnen den Entscheid der Prüfungskommission über die Anerkennung Ihrer ausländischen Patentanwaltsprüfung und gegebenenfalls über das Bestehen einer Eignungsprüfung (Art. 31 Abs. 1 Bst. b Ziff. 2 PAV). Sofern die eingereichten Unterlagen unvollständig sind oder Zweifel an deren Richtigkeit bestehen, kann das IGE gestützt auf Art. 31 Abs. 3 PAV zusätzliche Informationen oder Nachweise verlangen.

Per l’iscrizione nel registro dei consulenti in brevetti occorre fornire il documento rilasciato dalla camera d’esame attestante il superamento dell’esame federale per consulenti in brevetti (art. 31 cpv. 1 lett. b n. 1 OCB). Qualora l’esame non sia stato sostenuto occorre fornire la decisione della commissione d’esame concernente il riconoscimento dell’esame estero per consulenti in brevetti e, se del caso, il superamento dell’esame d’idoneità (art. 31 cpv. 1 lett. b n. 2 OCB). In virtù dell’articolo 31 capoverso 3 OCB l’IPI può richiedere ulteriori informazioni e prove se i documenti presentati non sono completi o vi sono dubbi circa la loro correttezza.
