Este princípio vem enunciado na Convenção das Nações Unidas de 1951 Relativa aos Refugiados, Artigo 33 (1) da seguinte forma: “Nenhum dos Estados Contratantes expulsará ou devolverá ("refouler") um refugiado, seja de que maneira for, para fronteiras dos territórios onde a sua vida ou a sua liberdade sejam ameaçadas em virtude da sua raça, religião, nacionalidade, filiação em certo grupo social ou opiniões políticas.” 30

163. The Commission has found no evidence that refugees were refouled as a result of the cessation clause. The Commission has not established any cases of imprisonment, arrest, and forcible repatriation. There was no concrete evidence brought to the attention of the Commission to the effect that such cases, if any, were linked to the promulgation and implementation of the cessation clause. The Respondent State demonstrated by providing figures, which were not refuted, of refugees who repatriated voluntarily prior to and after the cessation clause, as well as those who were granted further protection or alternative solutions to repatriation. The Complainant allegations that Articles 4, 5 and 6 of the African Charter were violated have not been proved.

165. L‘Etat défendeur nie avoir violé l‘article 7 de la Charte africaine. Il soutient qu‘il n‘existe pas de processus uniforme de détermination du statut de réfugié ni d‘appel en vertu du régime international des réfugiés. Il a déclaré avoir établi un mécanisme conjoint de détermination associant la Commission soudanaise des réfugiés et le HCR, chargé de déterminer les réfugiés qui n‘optaient pas pour un rapatriement volontaire en vertu de la décision n° 69 de l‘EXCOM. La Commission, tout en réitérant la nécessité d‘adopter des recours judiciaires en cas d‘échec de ce mécanisme administratif, prend note que l‘EXCOM a stipulé un mécanisme de réexamen des décisions par le même comité ou une autre autorité en cas de mécontentement d‘une décision du Comité conjoint.
