Wzory produktów lub ich części są chronione, gdy są nowe i wywierają odmienne całościowe wrażenie niż wzory wcześniej udostępnione publicznie. Ochronie nie podlegają jednak te cechy, które zdeterminowane są wyłącznie funkcją techniczną towaru (pisaliśmy już o tym na naszym portalu). Dotychczas istniały rozbieżności interpretacyjne, co tak naprawdę przesądza o tym, że dana cecha wynika wyłącznie z funkcji towaru. Rozwiewa je niedawny wyrok Trybunału Sprawiedliwości UE.

In traditional small scale societies, such as those of hunter-gatherers and small scale agricultural communities, this community of ~150 is the principal social or residential unit. In these cases, everyone knows everyone else, and indeed everybody’s social network of 150 people is more or less the same as everyone else’s, just structured in a different way (for example, my grandmother is your grandmother’s cousin). This close coherence in the community does two things. It provides a densely interconnected network in which the links between individuals allow everyone to keep up to date with who is doing what. In addition, it provides its own police force: the community acts as judge, jury and policeman on those who don’t fulfil the community’s expectations on how to behave.

En las sociedades tradicionales a pequeña escala, tales como las que formaban los cazadores-recolectores y las comunidades agrícolas a pequeña escala, esta comunidad de unos 150 individuos es la principal unidad social o residencial. En estos casos, todos los miembros se conocen, y de hecho esa red social de unas 150 personas es más o menos la misma para todos, aunque se estructure de forma diferente (por ejemplo, mi abuela es la prima de tu abuela). Este elevado grado de coherencia en la comunidad consigue dos cosas. Proporciona una red densamente interconectada en la que los vínculos entre las personas permiten que todos puedan mantenerse al día con lo que esté haciendo cada uno. Y además, aporta su propia fuerza policial: la comunidad actúa como juez, jurado y policía sobre aquellos que no cumplen con las expectativas de la comunidad sobre cómo comportarse.
