In a 1988 university study, youth court judges said they were frustrated because the lawyers in youth court failed to be actively involved in the disposition process. The first meeting was in November 1999, when some of those principles were established. We had eight meetings until March 2001. After 2001, we actually had two further meetings. I would make two further remarks, and one is in relation to the law as it relates to the legal profession. I have heard Mr. Hunter's remarks, and the CBA has made the same submission, that an independent bar is essential to the functioning of Canadian democracy. It's essential that lawyers be able to provide legal services without the fear of investigation or prosecution or compromise, and legal services must be specifically excluded from the ambit of the act.

One was proposed by a former Clerk of the Privy Council, Gordon Robertson, who has suggested what he called “contingency legislation” which would ensure that the authority of the Government of Canada continues after a secession referendum, until it is deliberately changed. That could establish a consultative committee including premiers and aboriginal leaders. While the legislation would be debated before a referendum, it need only be proclaimed after a “yes” vote.

During our meetings there were several important developments. One was that U.S. federal officials arrived to brief the Washington State Department of Transportation on how to structure their funding application for up to $800 million of this stimulus investment. The application has to be filed by June 17. Mayor Robertson signed a memorandum of agreement with Portland Mayor Sam Adams to promote passenger rail along the corridor with a view to laying the foundation for real high-speed rail. This memorandum is now being circulated to municipal leaders along the corridor for endorsement.

Bill C-28 is very problematic to me. The report put forward 30 recommendations, good recommendations, but only 1 of them was implemented. My colleague Ms. McLeod asked the Minister of State for Finance whether the recommendations would be followed. He said that the leader has the option of putting those recommendations in place, but is not required to do so. One of our problems with the bill is just that: the government put together this piece of legislation, but did not use it as an opportunity to set out a real strategy. And that's a shame because I wholeheartedly agree that it is important in terms of financial literacy.

Finally, there are the educational rights. There again we have two options: one is the fair dealing exception and the other is a blanket licence. I would like to ask you this. In the course of your discussions with the people involved...if you have a blanket licence, surely the licence can be adjusted in its cost and fees overall so it reflects the fact that some of the material is freely accessible and obtainable and other material is copyrighted. Surely that can be reckoned with and adjusted through the fee you charge. In other words, instead of having a blanket licence with a very high fee to make it blanket, you take into account in the fee structure, by consensus between the parties, that the intellect part is very different from the printed material.

I'm on the side of the growing number of distinguished economists who believe that the immediate cause of the current global recession wasn't the subprime fiasco in the U.S. or the related and unrelated shenanigans on Wall Street. The immediate cause of our economic woes was the collapse of the auto industry in North America and elsewhere, brought on by the run-up in oil prices last year. It really began in 2006-07, but it reached a peak last year. This run-up in oil prices was a response to two things. One was supply constraints, and the other was growing demand, particularly in industrializing countries.

That's the kind of question. There are many more technological questions, one of them raised by NTT DoCoMo in Japan, which, basically, has developed a TV phone, where everything is converging in the cell phone. This is a remarkable new technology, and the question is how we define broadcasting and what the future will hold. I think part of our problem is to envision the future. My suggestion to the researchers was that we could go to the MIT labs in Boston, we could go to the Bell labs, we could go to Wall Street. We could try to get a picture of what the industry will look like five years from now or ten years from now, and that might alter the way we look at these questions.

In only the last two weeks there have been two reports of serious attacks on individuals in the eastern upper Nile area. One was an attack at night. It was reported that 59 villagers were killed, ten children and six women were abducted, and a pastor of a Presbyterian Church and his family were burned to death in his hut. This is the kind of report that needs to be investigated--it needs to be investigated promptly--to be verified. That is not happening. We have a couple of these reports now that are not being investigated.
