While many vulnerable and low-income individuals face difficulties in acquiring nationality certificates due to costs and procedures throughout the application process, challenges to obtain a nationality certificate also relate to ethnicity. Certain communities, such as nomadic pastoralist groups, cannot access nationality certification procedure as they are not considered to be South Sudanese which effectively renders them stateless”, the Study points out.

First, the decision refers to both Article 7(2) of the Constitution and Section 4(3) of the Sudan Nationality Act of 1994 (as amended in 2011). The former gives an unconditional right to children born to a Sudanese mother to acquire Sudanese citizenship, i.e., they acquire it automatically.
Tout d’abord, la décision se réfère à la fois à l’article 7(2) de la Constitution et à l’article 4(3) de la loi nationale soudanaise sur la nationalité de 1994 (telle que modifiée en 2011). L’ancienne donne un droit inconditionnel aux enfants nés d’une mère soudanaise d’acquérir la nationalité soudanaise, c’est-à-dire qu’ils l’acquièrent automatiquement. Cette dernière donne le même droit, mais malheureusement à une condition, car elle exige que ces enfants introduisent une demande aux autorités compétentes concernées avant que la nationalité ne soit confirmée. La décision confirme quelque peu que cette condition est constitutionnelle, ce qui, au moins en théorie, donne au Ministère de l’Intérieur le droit de refuser leurs demandes, puisque la prise de décision implique toujours l’existence d’un pouvoir discrétionnaire pour approuver ou refuser la demande en question – même si, comme dans le cas de l’article 4(3), l’acquisition de la nationalité est censée être de droit une fois que la demande est faite. La décision de la Cour est conforme à sa décision antérieure dans l’affaire Benjamin, dans laquelle le plaignant a demandé que l’article 10(2) soit déclaré inconstitutionnel. La Cour, au lieu de le faire, s’est référée à l’article 4 (3) de la loi comme base pour qu’Iman Hasan Benjamin acquière la nationalité soudanaise. Il semble que la Cour ait cherché à éviter une décision selon laquelle la loi sur la nationalité soit inconstitutionnelle, malgré ses dispositions discriminatoires.
