8 were undertaken by foreign officials, the respondent instead has sought to implicate those actions undertaken in Canada which requested the search and seizure in Switzerland. But as Stone J.A. stated at p. 207:

32.                          En ce qui concerne l’applicabilité de l’art. 8 aux faits de la présente affaire, je dois respectueusement exprimer mon désaccord à l’égard de l’approche retenue par le juge Iacobucci.  Il affirme (au par. 42) que «[l]’objet principal du droit à la vie privée est par conséquent l’effet d’une fouille, d’une perquisition ou d’une saisie abusive sur l’individu; le lieu où cette mesure est exécutée est sans importance» (souligné dans l’original).  Même si je conviens que l’art. 8 protège «les personnes et non pas des lieux ou des choses», il ne protège les individus que contre les actions du gouvernement du Canada qui portent atteinte à la vie privée parce qu’elles constituent un recours abusif aux pouvoirs de fouille, perquisition ou saisie.  Par conséquent, le lieu de la fouille, de la perquisition ou de la saisie a effectivement de l’importance, si la mesure en question a été exécutée à l’extérieur du Canada par des personnes ne relevant pas de l’autorité du gouvernement canadien.  Il ressort clairement des faits de la présente cause que le gouvernement du Canada n’a procédé à aucune fouille, saisie ou perquisition.  Les autorités canadiennes n’ont fait que demander qu’il soit procédé à une fouille, perquisition ou saisie.  Puisque les actions qui sont à juste titre susceptibles d’examen en vertu de l’art. 8 de la Charte ont été prises par des responsables étrangers, l’intimé a plutôt tenté de mettre en cause la mesure prise au Canada, savoir la demande de fouille, perquisition et saisie en Suisse.  Cependant, comme l’a souligné le juge Stone, à la p. 207:
