Der Stimmzettelumschlag ist der Umschlag, in den der Stimmzettel bei der Briefwahl gesteckt werden muss. Bis zur Bundestagswahl 1998 bzw. zur Europawahl 1999 galt dies auch noch für die Urnenwahl. Seit der Bundestagswahl 2002 bzw. der Europawahl 2004 werden bei der Urnenwahl keine amtlichen Stimmzettelumschläge mehr verwendet.

Da der Ratifizierungsprozess in den Mitgliedstaaten jedoch erst nach der Europawahl 2009 abgeschlossen wurde, galt für die Europawahl 2009 eine veränderte Sitzverteilung auf die Mitgliedstaaten mit Reduzierung der Gesamtanzahl auf 736 Sitze, nach der Deutschland zunächst weiter durch 99 Abgeordnete vertreten ist.
Until the 2009 European election, Germany was represented - as from 1990 - by 99 members of the European Parliament, according to the Nice Treaty. This treaty was signed on 26 February 2001 and entered into force on 1 February 2003. From 732 members of the European Parliament elected in 2004, the number of seats increased in 2007 to 785 as 53 new members joined the European Parliament after the accession of the Republic of Bulgaria and Rumania to the European Union. The EU and EC Treaties as amended by the Nice Treaty contained the basic provisions concerning the European Parliament as well as the Citizenship of the European Union which provides the right to vote and to stand for European elections in any Member State.

Presently, the European Parliament has 736 seats. As a rule, the number of seats to which the individual member states of the European Union (EU) are entitled depends on population size and is based on the principle of degressive proportionality. Accordingly, the small EU member states have more seats in relation to the number of their population than large member states. Germany thus accounted for the maximum number of 99 seats, Malta received the minimum number of 5 seats. This had been laid down in the Treaty establishing the European Community as revised by the Treaty of Nice and last amended by the Acts of Accession of Bulgaria and Romania. The EU Reform Treaty of Lisbon, which has meanwhile been ratified by all member states and entered into force on 1 December 2009, provides for an upper limit of 751 seats (including the President) with a maximum of 96 seats (Germany) and a minimum of 6 seats (Malta) per member state.
