From the moment that it was announced that I was the winner of the PNK 2012-2013 Fellowship, I began to deepen and improve my research in order to express my ideas in the various venues offered by the city of New York and The New School University. There are certain issues discussed in the ICSID processes that are of vital importance to countries. The characteristics in which the system was designed (commercial or private disputes) are not the appropriate forum to discuss matters of water or energy supply or issues as public economic decisions such as negotiations of debt bonds and public welfare matters that should be decided in a more structured judicial proceeding.

A lo largo de este artículo hemos analizado el funcionamiento del CIADI y los TBIs. El objetivo principal de estos mecanismos ha sido proteger a las empresas privadas que invierten sus capitales en países en desarrollo, garantizándoles derechos que luego podrían ser esgrimidos en un foro internacional. El caso argentino nos ha mostrado muchos aspectos de este sistema, ya que el país había firmado más tratados bilaterales de inversión que ningún gobierno en la región y a su vez sufrió la crisis más importante de su historia. Así es como a través del análisis de los casos de Argentina en el CIADI pudimos ver claramente que el sistema tiene muchos problemas, como falta de transparencia y de independencia, contradicciones en sus decisiones, lentitud y un insuficiente nivel de revisión. Esto demuestra que ha sido ineficaz para el gobierno argentino y para los inversores que aún siguen discutiendo sobre acontecimientos que tuvieron lugar hace más de una década.
