A. Note 4 to Category 5, Part 2 in the Commerce Control List (Supplement No. 1 to part 774) excludes an item that incorporates or uses "cryptography" from Category 5, Part 2 controls if the item's primary function or set of functions is not "information security," computing, communications, storing information, or networking, and if the cryptographic functionality is limited to supporting such primary function or set of functions. The primary function is the obvious, or main, purpose of the item. It is the function which is not there to support other functions. The "communications" and "information storage" primary function does not include items that support entertainment, mass commercial broadcasts, digital rights management or medical records management.

R. La Note 4, Catégorie 5, section 2 de la liste de contrôle du commerce (supplément 1 à la section 774) exclut tout article utilisant de la « cryptographie » des contrôles de la catégorie 5, section 2 si la ou les fonctions principales de l'article ne sont pas liées à la sécurité informatique, au traitement de données, aux communications, aux informations de stockage ou à la mise en réseau, et si la fonctionnalité cryptographique est limitée à la prise en charge de ces fonctions principales. La fonction principale correspond bien entendu à l'utilisation principale de l'article. Il s'agit de la fonction qui n'a pas pour but de soutenir les autres fonctions. La fonction principale de « communications » et de « stockage d'informations » n'inclut pas les articles de divertissement, de diffusion commerciale en masse, de gestion des droits numériques ou d'archives médicales.
