Dla przeciwwagi warto odnotować rewizję założeń w odniesieniu do Liquidity Coverage Ratio (LCR) dokonaną 6 stycznia 2013 roku przez Komitet Bazylejski do spraw Nadzoru Bankowego. LCR jest jednym z kluczowych elementów nowego zestawu regulacji kapitałowych dla sektora bankowego (tzw. Basel III), mającego na celu stworzenie bezpieczniejszej bazy kapitałowej dla banków. Rewizja polegała na rozszerzeniu akceptowalnych aktywów o wysokiej płynności (w zakresie tzw. Level 2B assets), w które mogą inwestować banki w celu stworzenia wymaganej rezerwy płynnościowej (tzw. High Quality Liquid Assets – HQLA). W wyniku rewizji na liście dopuszczalnych instrumentów znalazły się m.in. papiery wartościowe zabezpieczone sekurytyzowanymi wierzytelnościami (np. RMBS o ratingu AA lub wyższym). Uzupełnienie listy HQLA o instrumenty oparte na sekurytyzowanych aktywach może przyczynić się do zwiększenia zainteresowania banków takimi instrumentami oraz, w konsekwencji, do zwiększenia liczby transakcji sekurytyzacyjnych.

Furthermore, providers can withdraw from price determination by ComCom during an active procedure by agreeing bilaterally, as the procedures then have to be aborted. Alternatively, telecommunications service providers can choose not to complain to ComCom in order to side-step price determination according to the TCA. Thus, as a result of the primacy of negotiation, the law promotes and legitimises collusion between providers; this obstructs competition and was certainly not the legislators’ intention.

La primauté des négociations prévue par la loi encourage et légitime donc la collusion, ce qui est néfaste pour la concurrence et ne correspond assurément pas à l’intention du législateur.

Ancora, i fornitori di servizi preferiscono non rivolgersi alla ComCom per sfuggire alla fissazione dei prezzi prevista dalla legge. La priorità data alle trattative, pertanto, promuove e legittima comportamenti collusivi da parte dei fornitori di servizi di telecomunicazione. Tali comportamenti ostacolano la concorrenza e non rientrano sicuramente tra gli scopi originari del legislatore.
