Das Urheberrecht im Sinn von Artikel 5 des Königlichen Erlasses Nr. 38 bezieht sich ausschließlich auf dieVermögensrechte, die mit der Verwertung des Werks durch Dritte verbunden sind. Es ist die zusätzliche Vergütung, auf die der Künstler Recht hat, sobald seine Kreation vom Käufer oder einem Dritten durch Reproduktion, öffentliche Aufführung, Adaptierung oder Übersetzung verwertet wird.

Copyright, as referred to in Article 5 of Royal Decree no. 38, exclusively regards the patrimonial rights linked to the exploitation of the work by a third party. It is the additional compensation that the artist is entitled to when his creation is being exploited by the purchaser or another third party through reproduction, publication, adaptation or translation.

Les droits d'auteur au sens de l'article 5 de l'arrêté royal n° 38 se rapportent uniquement aux droits patrimoniaux liés à l'exploitation de l'uvre par des tiers. Les droits d'auteur constituent alors la rémunération supplémentaire à laquelle l'artiste a droit dès que sa création est exploitée par l'acheteur ou un autre tiers par la reproduction, la représentation en public, l'adaptation ou la traduction.
