Unlike the youth offender legislation enacted since the adoption of the Young Offenders Act, this bill is not limited to proposing some amendments to the Act. Instead, it introduces a new act, the Youth Criminal Justice Act, which would repeal the present act.

Il introduit plutôt une nouvelle loi, la Loi sur le système de justice pénal pour les adolescents, qui abrogerait la loi actuelle. Ainsi, alors que l'ancienne Loi sur les jeunes délinquants fut maintenue en vigueur pendant 75 ans, voilà qu'à peine plus de 14 ans après l'entrée en vigueur de la Loi sur les jeunes contrevenants, et déjà 11 modifications dont certaine majeures, on se propose de la remplacer.

Mehr als 1,8 Millionen Diebstähle verzeichneten die Kriminalstatistiker im Jahr 1998, einem Jahr, in dem das Thema Kriminalität mit 19 Prozent auf Platz zwei lag und einen historischen Höchstwert erreichte. Dafür dürften aber weniger die Diebstahl-Delikte verantwortlich gewesen sein als vielmehr die spektakuläre Darstellung von Jugendkriminalität in den Medien. Angeregt wurden die Ängste damals unter anderem durch den „Fall Mehmet“, der als jugendlicher Intensivtäter Schlagzeilen machte. Nachdem in den Folgejahren die Angst vor Kriminalität wieder sank, ist aktuell ein Anstieg zu verzeichnen. 15 Prozent der Menschen sehen angesichts der Schlagzeilen von U-Bahn-Schlägern und Steuersündern Handlungsbedarf.
