In the area of criminal law, the Czech Presidency would like to strive for the adoption of legislation that has an added value and which is required from a practical point of view. In this regard, it is in the process of preparing a submission on its own initiative, addressing conflicts of competence within criminal proceedings. The aim of this proposed framework decision will be to create a mechanism for preventing and resolving conflicts of competence between the Member States which will be based on the exchange of information on ongoing criminal proceedings.

Primárním cílem novely této směrnice je umožnit členským státům zahrnout do výše těchto poplatků některé externí náklady (náklady vyplývající z negativního dopadu dopravy na životní prostředí). Konkrétně se jedná o náklady způsobené znečištěním ovzduší, hlukem a přetížením dopravy.

The Eurovignette Directive lays down rules the Member States must follow when introducing systems for charging heavy goods vehicles, whether in the form of motorway toll stickers or tolls, and setting the amounts of these charges. The primary aim of the amendment to this Directive is to enable Member States to include certain external costs in these charges (costs resulting from the negative environmental impacts of transport). More specifically, these are costs caused by air pollution, noise pollution and traffic congestion.

La directive Eurovignette établit les règles que les États-membres se doivent de respecter lors de l’instauration de systèmes de taxation des poids lourds, que ce soit sous la forme de vignettes ou de péages sur les autoroutes, et de la fixation du montant de ces taxes. L’objectif primaire de la modification de cette directive est de permettre aux États-membres d’inclure certains coûts externes (résultant de l’impact négatif des transports sur l’environnement) dans le montant de ces taxes. Concrètement, il s’agit des coûts liés à la pollution de l’air, au bruit et à la densité du trafic.

V oblasti trestního práva hmotného je předsednictví připraveno pokračovat ve finalizaci sjednávání směrnice o trestněprávním postihu za znečišťování moří loděmi. Za českého předsednictví je dále očekáváno předložení iniciativ Evropské komise revidujících Rámcové rozhodnutí o boji proti pohlavnímu vykořisťování dětí a dětské pornografii a Rámcové rozhodnutí o boji proti obchodování s lidmi.

In the field of substantive criminal law, the Presidency is prepared to continue finalising discussions on the Directive on criminal sanctions for ship-source pollution. The European Commission is expected to submit initiatives to review the Framework Decision on combating the sexual exploitation of children and child pornography, and the Framework Decision on combating trafficking in human beings. The Czech Republic is prepared to open an active debate on both proposals.

En ce qui concerne le droit pénal matériel, la présidence est prête à poursuivre la finalisation de la directive sur les actions pénales pour pollution des mers par les bateaux. Pendant la présidence tchèque devrait également être soumise l’initiative de la Commission européenne visant la modification de la décision-cadre relative à la lutte contre l’exploitation sexuelle des enfants et la pédopornographie et la décision-cadre relative à la lutte contre la traite des êtres humains. La République tchèque est disposée à lancer activement la discussion de ces deux propositions.
