لقد شهدت الدراسات التي تناولت خطاب حقوق المرأة تطوراً كبيراً في العقود الماضية والتركيز بشكل خاص على تأثير الدين على الأدوار القانونية والاجتماعية للمرأة. ويدور جدلٌ حالياً حول فرضية تقول بأن "التّحديان الكبيران أمام حقوق الإنسان بشكل عام وحقوق المرأة بشكل خاص في القرن الواحد والعشرين هما قوى التطرف الديني والعولمة الاقتصادية"1  إذا صحت هذه الفرضية فإنه يَسهلُ رؤية أثر الأصولية الإسلامية على حياة المرأة في الدول الإسلامية هذا بالإضافة إلى أنه لا يمكن تجاهل مكانة قانون الأحوال الشخصية (أو قانون الأسرة) في المجتمعات العربية والذي غالبا ما يُطلق عليه وصف "المَعقِل الأخير"2  للشريعة الإسلامية. ولعل هذا الوصف الأخير بوصف مستمد من معركة متعلق بعملية سنّ القوانين التي بدأها العثمانيون في القرن التاسع عشر واستمرت القوى الاستعمارية الأوروبية إذ رأت هذه العملية من أن التقدم يستوجب ترك الفقه الإسلامي التقليدي [الشريعة] وتبني النموذج القانوني السائد في أوروبا باستثناء قانون الأسرة [أو قانون الأحوال الشخصية] الذي بقي من صلاحية المحاكم الشرعية. نتيجة لما سبق فإن قانون الأسرة -وبالتبعية النساء- أصبح رمزا للهوية والنضال ضد الاستعمار والانتماء الديني. جعلت هذه المكانة المقدسة في المخيلة الجماعية لقانون الأسرة منه موضوعا حساساً على الدوام وأسهمت في تلقي فكرة إصلاحه على أنها هجوم على الإسلام والشريعة.

They rejected the idea that Islam had to be abandoned in order to achieve the protection of women’s rights and modernisation. Islamist feminists lobbied for reform and change, but within the framework of Islam. Their main argument is that Islam is not a monolithic religion and its ultimate goal is the best interests of society. Islamist feminists proposed the reform of discriminatory laws, not by appealing to Western values or states’ international responsibilities, but through scholarly interpretation of the Qur’an – a process named ijthad. This strategy, combined with years of activism, was behind King Mohammed VI of Morocco’s landmark reform of the Personal Status Law (Mudawwana) in 2004. Likewise in Tunisia, the 2011 uprisings mobilised women from all backgrounds and classes, including Islamist feminists, whose message was more accessible to rural and conservative women. In 2014 a new Constitution – far more favourable to women – was passed and the government withdrew its reservations to the Convention for the Elimination of all Forms of Discrimination Against Women (CEDAW). This achievement was – at least in part – due to the involvement of Islamist feminists who, again, promoted women’s rights from within an Islamic framework.

The handshake, initiated by the Dalai Lama himself, was passed between the people to arrive simultaneously with a 1.67 million strong Avaaz petition for meaningful dialogue. It was a tangible gesture of goodwill that culminated in a rally with a moment of silence for victims of the Sichuan earthquake. Thousands of Avaaz members joined online by lighting virtual candles for earthquake survivors and donating funds to purchase tents and other emergency supplies.
