وترجع وقائع القضية إلى 6 نوفمبر 2006 حيث تم إلقاء القبض على المدون واستجوابه بشأن كتاباته على مدونته، والتي اعتبرت النيابة العامة أنها تشكل ازدراءً للدين الإسلامي وتثير الفتنة و"تحوي بيانات وإشاعات مغرضة من شأنها تكدير الأمن العام" فضلاً عن إهانة رئيس الجمهورية. وقد أمرت النيابة بإحالة المدون إلى محكمة جنح محرم بك بالإسكندرية والتي قضت بالحكم السابق الإشارة إليه في فبراير 2007 وتم تأييد الحكم من محكمة الجنح المستأنفة في مارس 2007. ورغم أن محامين عن الشبكة العربية لمعلومات حقوق الإنسان طعنوا بالنقض على الحكم في مايو 2007 إلا أن المحكمة لم تبدأ في نظره إلا في شهر أغسطس 2009. يذكر أن فريق الأمم المتحدة المعني بالاحتجاز التعسفي قد أصدر في 23 مارس 2009 قراراً اعتبر فيه احتجاز السلطات المصرية لكريم عامر إجراءاً تعسفياً يخالف القانون الدولي وطالب بإخلاء سبيله
