وقد طالب النائب العام، المستشار عبد المجيد محمود، في مذكرة الطعن على الحكم ـ التي اطلع باحثو المبادرة المصرية للحقوق الشخصية على نسخة منها ـ بإلغاء الحكم الصادر في 24 سبتمبر 2008 عن محكمة استئناف الإسكندرية والذي كان قد قضى بضم الطفلين ماريو وأندرو (١٤ عامًا) إلى حضانة والدهما الذي تحول إلى الإسلام في عام ٢٠٠٠ وأقدم على تغيير ديانة الطفلين في الأوراق الرسمية في عام ٢٠٠٦. وقد استند الحكم المطعون فيه إلى تفسير المحكمة لمبادئ الشريعة الإسلامية، رغم أن المادة 20 من قانون الأحوال الشخصية تنص على بقاء الطفل في حضانة الأم حتى سن الخامسة عشرة، دون إشارة لديانة الأم الحاضنة (انظر الفقرة رقم 8 من تقرير حرية الدين والمعتقد في الربع الثالث من عام 2008).
