تضمن مسودّة الاتفاق الجديد فصلا بين السلطات التي كانت – بدون وجه حق – محتكَرة في الإعلان الدستوري بيد مؤسسة واحدة هي السلطة التشريعية. وتعطي الوثيقة السلطة التنفيذية إلى حكومة اتفاق وطني تتمتع بسلطات واسعة. وتتضمن الوثيقة استقلال الحكومة عن السلطة التشريعية. لقد أثبتت الأحداث التي توالت على ليبيا بعد انتخاب المؤتمر الوطني العام في عام 2012 أنه من غير الممكن أن يُحكَم بلد ما من قبل برلمان مؤلف من مائتي شخص. وقد ثبت أن نقل السلطة من يد حاكم فرد واحد إلى حكومة جمعية كان له أثر تدميري. وقد جاءت مسودّة اتفاق ليون لتفصل بين السلطات ولتجعل العلاقة بين هذه السلطات قائمة على أساس المراقبة والتوازن بحيث لا يطغى فرع من فروع الحكومة على الفرعين الآخرين.
