The duty to implement IHL and human rights lies first and foremost with States. Humanitarian law obliges States to take practical and legal measures, such as enacting penal legislation and disseminating IHL. Similarly, States are bound by human rights law to accord national law with international obligations. IHL provides for several specific mechanisms that help its implementation. Several WHO programmes, such as those for the emergency response to outbreaks of poliomyelitis, measles, epidemic-prone meningitis, and yellow fever, have acquired considerable experience in the urgent mass delivery of vaccines in developing countries. Less experience exists for the mass delivery of antiviral drugs, where administration is complicated by the need for drugs to be taken over several days and the need for different dosing schedules according to therapeutic or prophylactic use. WHO will develop and pilot test delivery mechanisms for antiviral drugs in collaboration with national health authorities and industry. Studies will assess coverage rates that could be achieved, taking into account compliance rates, and ways to support this intervention with other measures, such as area quarantine.

IOM specifically suggests that indicators should be quantitative – i.e. tied to numbers, such as the number of people served, or the average time participants spend in a program – but there are other ways to assure that accountability is measurable. Qualitative measures such as observation, participants’ own reports, and community impressions may also provide accurate and important information relating to accountability.
