Migrants arriving irregularly in a new country and victims of trafficking stopped by the police are often detained in administrative centers or in prisons. Overcrowded immigration detention centers often have poor access to healthcare, inadequate food, sanitation or safe drinking water and a lack of separate sanitation facilities for men and women. Equally, there is an increasing tendency to criminalize migration offenses, which has, in some cases, resulted in violations of migrants’ rights.

22.        The Committee encourages the State party to continue providing training on the Convention to the various officials involved in the protection of migrants’ rights, particularly public prosecutors, judges, magistrates and personnel involved in the administration of justice, and to ensure that this training is provided on a permanent and continuous basis and is taken into account in the performance evaluations and promotion of those officials.

23-   ترحب اللجنة بقرار محكمة العدل العليا الصادر في تشرين الثاني/نوفمبر 2008 الذي قضت فيه المحكمة بأن العمال المهاجرين يتمتعون بحقوق العمل نفسها التي يتمتع بها المواطنون بصرف النظر عن وضعهم كمهاجرين. وتحيط اللجنة علماً أيضاً بإجراء مجموعة بيتا (Beta Group) الرامي إلى نشر معلومات عن حقوق العمال المهاجرين. بيد أن اللجنة تشعر بالقلق لأن العمال المهاجرين وأفراد أسرهم لا يزالون يعانون من مختلف أشكال التمييز، ولا سيما التمييز على أساس الأصل الإثني ونوع الجنس، ومن الوصم في وسائط الإعلام والمجتمع عامة.
