However, in order to satisfy the basic domestic needs of the Parties operating under paragraph 1 of Article 5, its calculated level of production may exceed that limit by a quantity equal to the annual average of its production of the controlled substances in Group I of Annex A for basic domestic needs for the period 1995 to 1997 inclusive. This paragraph will apply save to the extent that the Parties decide to permit the level of production or consumption that is necessary to satisfy uses agreed by them to be essential.

٤- على كل طرف أن يضمن لفترة الإثني عشر شهراً التي تبدأ في ١ كانون الثاني/يناير ١٩٩٦ ، وفي كل فترة إثني عشر شهراً بعد ذلك ، ألا يتجاوز المستوى المحسوب لاستهلاكه من المواد الخاضعة للرقابة من المجموعة الأولى في المرفق ألف الصفر. وعلى كل طرف ينتج مادة واحدة أو أكثر من هذه المواد أن يضمن ، خلال الفترات نفسها ، ألا يتعدى المستوى المحسوب لإنتاجه منها الصفر. غير أنه يجوز للمستوى المحسوب لإنتاجه أن يتعدى هذا الحد بكمية تساوى المتوسط السنوي لإنتاجه من المواد الخاضعة للرقابة المدرجة في المجموعة الأولى من المرفق ألف لسد الاحتياجات المحلية الأساسية للأطراف العاملة بموجب الفقرة ١ من المادة ٥ للفترة من ١٩٩٥ إلى ١٩٩٧ بأكملها. ولا تطبق هذه الفقرة إلا بالقدر الذي تقرره الأطراف ، للسماح بمستوى الإنتاج أو الاستهلاك اللازم لتلبية الاستخدامات التي يتفق الأطراف على أنها ضرورية.
