EUPOL COPPS is currently working with the key Palestinian Criminal Justice Institutions (CJIs) in developing a coherent legal framework which clearly defines their respective mandates, roles and responsibilities. Activities currently being undertaken are the building up of consensus between the CJIs; the implementation of coordination mechanisms and instruments that guarantee effective cooperation between the CJIs; and  the provision of technical assistance aimed at contributing to local efforts to review, update, and implement legislation with respect to the clarification of the mandates of the CJIs.

The Committee is concerned that, when a person with a psychosocial or intellectual disability is declared to be exempt from criminal responsibility in criminal proceedings, due process guarantees are not upheld and the person is immediately deprived of his or her liberty without even having been shown to be linked to the event in question.

Persons charged with criminal offences, including terrorism-related crimes, are entitled to the usual series of specific due process rights, including that all persons should be equal before the courts and tribunals, the right to be presumed innocent, the right to a hearing with due process guarantees, to be tried within a reasonable time, to be tried by a competent, independent and impartial court or tribunal, and a right to have a conviction and sentence reviewed by a higher court or tribunal in conformity with international human rights law.
