وذكرت المحكمة أنها قد اطمئنت إلى شهادة اثنين من الشهود تقدم بهما المدعي إلى المحكمة وقررا أن الأم قد "اعتنقت البهائية وارتدت عن الدين الإسلامي". واستخلصت المحكمة من الشهادتين أن الأم "قد اعتنقت ما يسمى بالديانة البهائية ومن ثم تكون قد ارتدت عن الدين الإسلامي، الأمر الذي تكون معه قد فقدت شرطاً من شروط حضانتها للصغير آسر، وهو شرط عدم الارتداد عن الدين الإسلامي.. وأن وجود الصغير مع المدعى عليها الأولى – الأم – فيه أبلغ الضرر." يذكر أن الطفل ووالديه لم يحضروا أياً من جلسات نظر الدعوى بعد سفرهم إلى خارج البلاد عقب إقامة الدعوى.

تمثل الالتزام العملياتي الجديد التالي والنهائي لحلف شمال الأطلسي في منطقة البلقان في العمليات العاجلة الثلاث المتتالية الصغيرة التي تمت في الفترة من 2001 إلى 2003 في جمهورية مقدونيا اليوغوسلافية السابقة -"الحصاد الجوهري"، و"الثعلب الكهرماني"، و"تناغم الحلف"- لنزع سلاح الجماعات المسلحة غير النظامية وجمع أسلحتها وحماية المراقبين الذين تم إرسالهم من قبل الاتحاد الأوروبي ومؤسسة الأمن والتعاون في أوروبا وتعزيز الأمن، على التوالي. وقد تم تدعيم هذه العمليات بمسار دبلوماسي منسق ومحدد عن قرب من قبل حلف شمال الأطلسي والاتحاد الأوروبي، عكس نشأة شراكة جديدة ولدت من رحم الخبرة المشتركة في كوسوفو. وفي آذار/مارس 2003، تلت عملية "تناغم الحلف" عملية "كونكورديا" التي نفذها الاتحاد الأوروبي، لتفتح الباب أمام تولي الاتحاد الأوروبي للعمليات بدلاً من حلف شمال الأطلسي في الحالات التي تسمح فيها الظروف على الأرض والوضع الدولي بذلك.
