Естествено е жертвата да иска да бъде обезщетена за причинените вреди и загуби. Отговорността за плащане на подобен род обезщетения във всички държави-членки пада върху извършителя. Тази отговорност, наречена гражданска отговорност, се покрива от гражданското право на всяка държава-членка и задължава извършителя да заплати обезщетение на жертвата за покриване на причинените щети. Отговорността на извършителя да заплати обезщетение на жертвата се отличава от неговата/нейната престъпна отговорност срещу държавата. Щетите се отнасят до отношенията между извършителя и жертвата, и принципно жертвата е тази, която следва да поиска заплащането на тези щети в гражданските съдебни процедури. Престъпната отговорност засяга отношенията между престъпника и държавата. Компетентните органи (полиция, прокурор, разследващите органи) са тези, които търсят доказателства срещу извършителя относно неговата вина, а решението се взема по процедурата на наказателното дело. Ето защо, основния начин за търсене на обезщетение от жертвата е чрез завеждане на дело срещу извършителя.
