La clause de réparation contenue à l’article 14 de la directive 98/71 et à l’article 110 du règlement n° 6/2002 doit-elle être interprétée en ce sens qu’elle crée un droit subjectif dans le chef des entreprises tierces produisant des pièces de rechange et des accessoires et que ce droit subjectif comporte le droit pour ces entreprises tierces d’utiliser sur les pièces de rechange et les accessoires, la marque d’autrui enregistrée, par dérogation aux dispositions du règlement n° 207/09 et de la directive 89/104 lorsque le titulaire du droit de marque appose également le signe distinctif en cause sur la pièce de rechange ou sur l’accessoire destiné à être monté sur le produit complexe, de façon à ce qu’il soit apparent extérieurement et concoure ainsi à l’apparence externe du produit complexe ?
