On June 11, 2015 Ms. Marie Daunay and Mr. Wadih Al-Asmar, respectively President and Secretary General of the Lebanese Centre for Human Rights (CLDH), will appear before the Publication Court for a second public session in an investigation commenced in March 2011. The two human rights defenders are accused of “defamation” and could face up to a one-year jail sentence and a fine. CLDH is a member organisation of EMHRN, working on arbitrary detention, torture and enforced disappearance.

Indeed, the Iranian regime has made the very membership in and practice of the Baha’i religion a crime in itself. In effect, the persecution and prosecution of the Yaran is in standing violation of both Iranian law and international treaties to which Iran is a state party. These violations include arbitrary, illegal, and prolonged detention; torture and ill treatment; false charges, such as spreading corruption on earth, a capital crime; denial of the right to an effective trial; and hearings devoid of any semblance of due process before a politicized judiciary.

Further, the advisory group looks for risk to life, the proverbial bullet with a person's name on it. Even the current standard is not so high. Amnesty believes the risk to consider is the risk—and here we go back to our mandate—to arbitrary detention, torture, disappearance, and execution. If those risks are identified, then the removal should not proceed. What if the person is at risk in some parts of the country but not in other parts of the country? The advisory group says the removal goes ahead unless the person is at risk in every part of the country. This parallels the current standard for the post-determination review.
