We are perhaps in a situation for reversed burden of proof. Proving the safety of a chemical for the industrialist is quite different than to prove its toxicity in case of problems, which been the burden of governments. The evaluation of costs and gains of the ISO 26000 standard REACH (Registration Evaluation and Authorization of Chemicals) by the European Commission is 2.3 billion Euros, or 0.05% of the turnover of the chemical industry. This is a savings of 50 billion over a 25 year period in spending on health and environmental costs for public finances.

The Greens believe the onus should be on industry to show that the products they produce are safe, contrary to the current onus on government to demonstrate harm from these products. An industry onus is a key feature of the emerging REACH (Registration, Evaluation, and Authorization of Chemicals) system for regulating chemicals in the European Union (EU) that came into force on June 1, 2007. Europe is the largest chemicals market in the world. We believe that Canada must follow their lead. It is essential that the legal framework of ‘toxic’ substances not be eroded in CEPA, but rather, be expanded. We believe CEPA must be amended to cover the non-commercial uses of pesticides, thus allowing the Pest Control Products Act to continue to regulate the registration and use of pesticide products, while banning of dangerous pesticide substances and handling of disposal and spills are dealt with by CEPA. We believe CEPA should be extended to control toxic radionuclides, pesticides, and many other substances shown to be of significant risk to health.

La LCPE doit être amendée de façon à couvrir les aspects non commerciaux des pesticides, et ainsi la Loi sur les produits antiparasitaires pourra continuer à réglementer l'enregistrement et l'utilisation des pesticides tout en transférant à la LCPE l'interdiction des substances dangereuses et la gestion des déchets et déversements accidentels. Nous voulons que la LCPA soit élargie de façon à couvrir le contrôle des radionucléides toxiques et des pesticides, ainsi que bien d'autres substances dont le caractère nocif pour la santé humaine a été prouvé.
