Our view is that the provision has been around for many years. It's not unusual commercial practice, when you get into disputes, to have a two-step process. Step one, you determine the validity of the dispute, and then step two, you try to determine what is reasonable recourse.

Je crois comprendre, monsieur Volpe, que l’Alberta considère que la Loi renferme d’autres dispositions visant le préjudice commercial. Selon nous, cet article existe depuis de nombreuses années. Il n’est pas inhabituel de suivre un processus en deux étapes dans le cas d’un conflit. Premièrement, on détermine la validité du différend, et deuxièmement, on tente de trouver le recours qui convient. Cela dépend en partie du préjudice qui a été causé par quelqu’un qui n’a pas fait ce qu’il fallait. Notre position est très simple. Il s’agit d’une pratique courante qui fonctionne depuis longtemps à l’OTC. C’est logique que nous examinions la question sous un autre angle; toutefois, jusqu’ici, rien ne justifie que nous déviions de la pratique commerciale habituelle. Le seul argument que nous avons entendu jusqu’à présent, c’est qu’on le fera, mais au moyen d’une autre disposition législative. L’OTC devra encore déterminer si l’expéditeur subirait un préjudice commercial important avant de lui accorder un recours. Pourquoi réparer un instrument qui fonctionne bien? C’est vraiment le raisonnement que nous suivons.
