During our investigation of this case, the company, in relation to the allegation that the ‘stop’ command was not working, admitted that there were technical issues with the opt-out service of its text provider and stated that it had it acted immediately to rectify this once it became aware of it. On the matter of marketing consent, the company informed our investigation that the complainant had logged onto the Wi-Fi at its Lower Baggot Street, Dublin outlet in April 2016. It described how a user must enter their mobile phone number on the sign-in page following which they receive a PIN number to their phone which enables the user to proceed. After entering the PIN correctly, the customer is presented with a tick box to accept the terms of service which includes a privacy policy. Having examined the matter, we advised Paddy Power Betfair Plc that we did not see any evidence that the user was given an opportunity to opt out of marketing as is required by S.I. 336 of 2011 (the ePrivacy Regulations). We formed the view that the company was unable to demonstrate that the complainant unambiguously consented to the receipt of marketing communications. The company understood our position and it undertook to work with its Wi-Fi providers to add the required marketing consent tick box on its registration page. It also immediately excluded all mobile phone numbers acquired through the Wi-Fi portals from further marketing communications.
D’admhaigh an chuideachta le linn ár n-imscrúdaithe den chás, i dtaca leis an líomhaint nach raibh an t-ordú ‘stop’ ag feidhmiú, gur bhain roinnt saincheisteanna teicniúla don tseirbhís dhíliostála dá soláthraí téacs, agus mhaígh gur bheartaigh siad láithreach bonn chun é sin a cheartú ach ar éirigh siad feasacht fúthu sin. Maidir leis an toiliú don mhargaíocht, thug an chuideachta le fios dár n-imscrúdú gur logáil an gearánaí isteach ar an Wi-Fi ag a siopa ar Shráid Bhagóid Íochtarach, Baile Átha Cliath i mí Aibreáin 2016. Thuairiscigh siad an chaoi nach foláir d’úsáideoir uimhir a bhfóin phóca a iontráil sa leathanach isteach, agus go bhfaigheann siad uimhir PIN dá bhfón ina dhiaidh sin chun cur ar a gcumas chun dul ar aghaidh. Tar éis dóibh an PIN a iontráil i gceart, tugtar ticbhosca don chustaiméir chun glacadh leis na téarmaí seirbhíse lena n-áirítear beartas príobháideachais. Tar éis dúinn an cás a iniúchadh, thugamar le fios do Paddy Power Betfair Plc nach bhfacamar fianaise ar bith gur tugadh an deis don úsáideoir chun díliostáil ón margaíocht faoi mar is gá faoi I.R. 336 de 2011 (Na Rialacháin ríomh-Phríobháideachais). Thángamar chun na tuairime nárbh fhéidir leis an gcuideachta a léiriú gur thoiligh an gearánaí go glan soiléir le fáil na cumarsáide margaíochta. Thuig an chuideachta ár seasamh, agus gheall siad chun saothrú lena soláthraithe Wi-Fi chun an ticbhosca margaíochta riachtanach a chur lena leathanach clárúcháin. D’eisiaigh siad láithreach bonn freisin gach uimhir fhóin phóca a fuair siad trí na tairseacha Wi-Fi óna thuilleadh cumarsáide margaíochta.
