1(c) Mobile Software from Apple App Store. This paragraph 1 (c) is intended to apply to you if you have downloaded the Mobile Software from the Apple App Store. Artec and you acknowledge that this Agreement is concluded between Artec and you only, and not with Apple Inc. (“Apple”), and as between Artec and Apple, Artec, not Apple, is solely responsible for the Software and Artec Services and the content thereof. You acknowledge that Apple, Inc. has no obligation whatsoever to furnish any maintenance and support services with respect to the Mobile Software. You acknowledge that you have reviewed the App Store Terms and Conditions (located online at http://www.apple.com/legal/itunes/us/terms.html#APPS). You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) You are not listed on any U.S. Government “watch list” of prohibited or restricted parties, including the Specially Designated Nationals list published by the Office of Foreign Assets Control of the U.S. Treasury or the Denied Persons List published by the U.S. Department of Commerce. This Agreement incorporates by reference the Licensed Application End User License Agreement (the “LAEULA”) published by Apple, Inc. (located online at http://www.apple.com/legal/itunes/appstore/dev/stdeula/). For purposes of this Agreement, the “Mobile Software” is considered the “Licensed Application” as defined in the LAEULA, and “Artec” is considered the “Application Provider” as defined in the LAEULA. If any terms of this Agreement conflict with the terms of the LAEULA, the terms of this Agreement shall control.

1 (c) Мобильное программное обеспечение из онлайн-магазина приложений AppleAppStore. Этот параграф 1 (с) предназначен для тех, кто скачал Мобильное программное обеспечение из онлайн-магазина приложений AppleAppStore. Компания Artecи вы соглашаетесь с тем, что данное Соглашение заключено только между вами и компанией Artec, а не с компанией AppleInc. (далее – «Apple»), а также между компаниями Artecи Apple. Компания Artec, но не Apple, несет единоличную ответственность за Программное обеспечение и Сервисы Artec, а также их контент. Вы соглашаетесь с тем, что компания AppleInc. не имеет каких-либо обязательств предоставлять обслуживание и услуги по поддержке касательно Мобильного программного обеспечения. Ты подтверждаете, что изучили Условия и положения онлайн-магазина AppStore (находящиеся по ссылке http://www.apple.com/legal/itunes/us/terms.html#APPS). Вы заверяете и гарантируете, что (i) вы не находитесь в стране, на которую правительство США наложило эмбарго, и что её правительство США не обозначило как «страну, поддерживающую терроризм»; и (ii) что вы не находитесь в «черных списках» запрещенных и ограниченных лиц, изданных Правительством США, в том числе что вы не являетесь лицом, находящимся в Списке граждан особых категорий и запрещенных лиц, изданным Управлением по контролю за иностранными активами Министерства финансов США, или же что не находитесь в санкционном списке, изданном Министерством торговли США. Данное Соглашение включает путем отсылки Лицензионное соглашение с конечным пользователем лицензированного приложения (ЛСКПЛП), опубликованное компанией AppleInc. (находящееся по ссылке http://www.apple.com/legal/itunes/appstore/dev/stdeula/). Для целей этого соглашения Мобильное программное обеспечение считается «Лицензионным приложением», как это прописано в ЛСКПЛП, и компания Artecсчитается «Провайдером приложения», как это определено в ЛСКПЛП. Если какие-либо условия данного Соглашения противоречат условиям ЛСКПЛП, то следует руководствоваться условиями данного Соглашения.
