I very much look forward to working with all Member States over the coming mandate. The politics of intellectual property are, in my view, becoming more, rather than less, challenging. I do not think that this is a disturbing development. Rather, I would view it as a natural consequence of the increased economic value of intangibles and innovation and of the mission of intellectual property of finding the right balance in relation to all the interests that surround innovation in our society. However, while Member States are primarily responsible for managing the politics, the heightened level of challenge also means that I am going to need a lot of help over the coming years. I hope that I shall be able to count on the support and charitable disposition of both the Member States and the staff. I look forward to working with you all.

Espero con interés trabajar con todos los Estados miembros durante el próximo mandato. A mi juicio, la política de la propiedad intelectual resulta cada vez más ardua, en lugar de hacerse menos complicada. Esta evolución no me parece un hecho inquietante. Más bien, me gustaría verla como la consecuencia natural del aumento del valor económico de los activos intangibles y la innovación y de la misión de la propiedad intelectual de encontrar el equilibrio adecuado en relación con todos los intereses que rodean a la innovación en nuestra sociedad. Sin embargo, si bien los Estados miembros son los principales responsables de la gestión de las políticas, la intensificación de los desafíos también significa que voy a necesitar mucha ayuda en los próximos años. Unfortunately, one partner’s attempts to make things better may be at odds with the other’s sense of where things need to go. As a result, husbands and wives can end up putting all their effort into cross-purposes. For instance, let’s say she’s hoping they’ll get to the point where they can talk openly about the problem, while he really wants to get to the point where they’ve moved past it. To him, her efforts seem counterproductive, and vice-versa. As she becomes more adamant about the need to talk, he tries to avoid the topic more. Rather than feeling understood, she feels dismissed. She concludes that he doesn’t take the problem seriously enough. She wonders if his sinful behavior has deadened his conscience and impaired his capacity to empathize with her pain. He fears that she’s becoming obsessed about the problem, he's fighting this by himself because it's “his problem,” and he wonders if he’ll ever be able to redeem himself in her eyes.

This is not a controversial demand, but once again little attention has thus far been directed to the human rights consequences that will result from failure to plan well in advance. For example, if technology transfer is slow or not forthcoming, individuals in many countries will inevitably be reliant on carbon-based energy supplies for their immediate developmental needs. A human rights sensitive approach to technology will therefore be attentive to the possibility that access to carbon-intensive technologies may be needed more, rather than less, in some poorer countries, at least in the mid-term. It can help in assessing the extent to which help is needed for countries moving towards less carbon-intensive energy paths, and provide guidance on where and how that help can best be targeted. The long-term fulfillment of basic human rights – to food, water, property, health and shelter, and even culture and livelihoods – will depend, in many countries, on a measured, structured and informed passage from carbon to clean fuels. Awareness of these demands provides an appropriate basis for testing and fleshing out promises of future technological progress – which currently remain vague – against hard needs that already exist and will only worsen over time.

Esta no es una petición controvertida, pero hasta ahora se le ha prestado muy poca atención a las consecuencias que tendría para los derechos humanos una falta de tiempo en la planificación. Por ejemplo, si la transferencia de tecnología se realiza lentamente o no se lleva a cabo, inevitablemente individuos de muchos países deberán acceder a suministros energéticos basados en el carbono para satisfacer sus necesidades inmediatas de desarrollo. Por consiguiente, hay que considerar la posibilidad de que el camino a la tecnología, teniendo en cuenta los derechos humanos, puede implicar que sea más necesario, en vez de menos, el acceso a las tecnologías ricas en carbono en algunos países pobres, al menos a medio plazo. Puede ser útil evaluar hasta qué punto necesitarán ayuda los países que cambian a energías menos ricas en carbono, así como ofrecer una orientación de hacia dónde y cómo es mejor dirigir la ayuda. En muchos países, el respeto a largo plazo de los derechos humanos básicos (relacionados con los alimentos, el agua, la pobreza, la salud y la vivienda, e incluso la cultura y los medios de vida) dependerá de que el paso del carbón a los combustibles limpios se haga de forma estructurada, controlada y con la información suficiente. A matter which has been of particular concern to the Committee in the examination of the reports of States parties is the adverse impact of the debt burden and of the relevant adjustment measures on the enjoyment of economic, social and cultural rights in many countries. The Committee recognizes that adjustment programmes will often be unavoidable and that these will frequently involve a major element of austerity. Under such circumstances, however, endeavours to protect the most basic economic, social and cultural rights become more, rather than less, urgent. States parties to the Covenant, as well as the relevant United Nations agencies, should thus make a particular effort to ensure that such protection is, to the maximum extent possible, built-in to programmes and policies designed to promote adjustment. Such an approach, which is sometimes referred to as "adjustment with a human face" or as promoting "the human dimension of development" requires that the goal of protecting the rights of the poor and vulnerable should become a basic objective of economic adjustment.
