La Convención de las Naciones Unidas sobre los Derechos del Niño ha alcanzado una ratificación casi universal. La Convención establece que los niños tienen derecho a ser protegidos contra el desempeño de cualquier trabajo que pueda ser peligroso o entorpecer su educación, o que sea nocivo para su salud o para su desarrollo físico, mental, espiritual, moral o social. Además establece que la enseñanza primaria debe ser obligatoria y gratuita para todos y fomenta el desarrollo, en sus distintas formas, de la enseñanza secundaria y hacer que todos los niños dispongan de ella y tengan acceso a la misma. La Asamblea General de las Naciones Unidas también ha adoptado dos Protocolos facultativos de la Convención para aumentar la protección de los niños contra la participación en conflictos armados y la explotación sexual3.

6. Trabajo infantil: Las Naciones Unidas esperan al menos que sus proveedores no realicen prácticas incompatibles con los derechos establecidos en la Convención sobre los Derechos del Niño, el Convenio sobre la edad mínima de admisión al empleo de la OIT (C.138-1973) o el Convenio sobre la prohibición de las peores formas de trabajo infantil y la acción inmediata para su eliminación (C. 182-1999). La edad mínima de admisión al empleo o al trabajo no será inferior a la edad de finalización de la escolarización obligatoria, que no suele ser inferior a 15 ó 14 años, cuando así lo permita la legislación nacional. Además, todos los trabajadores jóvenes deberán estar protegidos contra la obligación de realizar trabajos que puedan ser peligrosos, interferir en su educación o ser perjudiciales para su salud o desarrollo físico, mental, social, espiritual o moral. Asimismo, todos los proveedores deberán cumplir los programas reglamentarios de aprendizaje en el lugar de trabajo, así como todas las leyes y reglamentos que regulen el trabajo infantil y los programas de aprendizaje.
