El 14 de agosto de 2006, los Estados Unidos notificaron su propósito de apelar contra determinadas cuestiones de derecho e interpretaciones jurídicas formuladas por el Grupo Especial. El 10 de octubre de 2006, el Presidente del Órgano de Apelación informó al OSD de que, teniendo en cuenta el tiempo que se necesitaba para la finalización y traducción del informe, el Órgano de Apelación no podría distribuirlo dentro del plazo de 60 días. El Órgano de Apelación preveía concluir su labor a más tardar el 13 de noviembre de 2006.
