2. Except as otherwise provided in this Understanding, resort to arbitration shall be subject to mutual agreement of the parties which shall agree on the procedures to be followed. Agreements to resort to arbitration shall be notified to all Members sufficiently in advance of the actual commencement of the arbitration process.

Before the beginning of the arbitration, the parties must notify their agreement to resort to arbitration to all (WTO) Members. Other Members may become party to an arbitration only with the agreement of the parties engaged in the arbitration.

Antes del comienzo de las actuaciones del arbitraje, las partes deben notificar su acuerdo de recurrir al arbitraje a todos los Miembros de la OMC. Los demás Miembros sólo podrán participar en el arbitraje con el acuerdo de las partes directamente interesadas. Las partes convendrán en acatar el laudo arbitral que, una vez emitido, deberá notificarse al OSD y a los Consejos y Comités pertinentes que supervisen los acuerdos en cuestión (párrafos 2 y 3 del artículo 25 del ESD). Las disposiciones de los artículos 21 y 22 del ESD sobre las medidas correctivas y la vigilancia de la aplicación de la decisión son aplicables también al laudo arbitral (párrafo 4 del artículo 25 del ESD).
