These conclusions derive from the Directive itself; .... If a claimant can satisfy the court that he is a member of the public concerned the Directive requires that he enjoys wide access to justice. Such a person will not enjoy that right if the proceedings in which he must engage are "prohibitively expensive". One of the ways in which a court can ensure that proceedings are not prohibitively expensive is by making a protective costs order upon appropriate terms in favour of a claimant. "
