It would not be feasible to regard the individual members from time to time of the Council or the Band as the employers. In effect, it is not clear who, on strict legal tests, could be considered to be the employer, having regard to the question of legal personality and the question of authority to make contracts on someone else’s behalf. Yet there is clearly a situation in which persons have the status of employees. In these circumstances, I think the Board should be held to have jurisdiction to treat the Band Council as the employer for purposes of the Code.
