In case T 773/07, which concerned the Arrangements for deposit accounts in force until 12.12.2007 (Supplement to OJ 1/2005), the appellant's deposit account held insufficient funds to cover the appeal fee. The board rejected the argument that this fee could or should have been booked before six other fees on the relevant date. It was not for the EPO cashier to choose priorities between fees to be paid, all the more so since it was the responsibility of the account holder to ensure that the account contained sufficient funds at all times (point 5.2 ADA).

For the majority of Rwandans, the ICTR is a useless institution, an expedient mechanism for the international community to absolve itself of its responsibilities for the genocide and its tolerance of the crimes of the RPF. The Rwandan government complains of the squandering of money and resources while 130,000 prisoners fill its jails and its courts have tried more than 4,000 suspects; the survivors of the genocide find the tribunal distant and indifferent to their lot, and the victims of the crimes of the RPF denounce it as an instrument of the Kigali regime, seeing the ICTR as a symbol of victor’s justice.

Mr. Howard Greenberg: I agree you could do it that way, or you could decide you want to determine priorities between various classes--for example, entrepreneurs as opposed to these skilled workers. How would that be done? The more resources you put toward interviewing entrepreneurs, the more entrepreneurs are processed and given visas. It's simply an issue of how you allocate your resources. If you only have one officer interviewing a backlog of 1,000 entrepreneurs, how many entrepreneur visas do you think will be issued?

The generous language of the Act confers a broad discretion on the court and, combined with the rule in the Interpretation Act that a statute is always speaking, means that the Act must be read in light of modern values and expectations. The first consideration in determining what is "adequate, just and equitable" in the circumstances of the case must be the testator's legal responsibilities during his or her lifetime. Maintenance and provision for basic needs may or may not be sufficient to meet this legal obligation. Depending on the length of the relationship, the contribution of the claimant spouse and the desirability of independence, each spouse is entitled to a share of the estate. For further guidance in determining what is "adequate, just and equitable", the court should next turn to the testator's moral duties toward spouse and children. Where priorities among conflicting claims must be established, claims which would have been recognized during the testator's life should generally take precedence over moral claims. As between moral claims, some may be stronger than others. Any moral duty should be assessed in the light of the deceased's legitimate concerns which, where the assets of the estate permit, may go beyond providing for the surviving spouse and children. A will is the exercise by the testator of his freedom to dispose of his property and is to be interfered with not lightly but only in so far as the statute requires.
