Bien que le français fût parlé et enseigné dans certaines écoles acadiennes, on fermait généralement les yeux sur ce fait. La plupart des manuels scolaires utilisés dans les écoles étaient en anglais, mais des enseignants réussissaient à l'occasion à mettre la main sur des manuels français.

The public schools of New Brunswick were officially English-language institutions. Although French was spoken and taught in some Acadian schools, people generally looked the other way. Most of the textbooks used in the school system were in English, but teachers sometimes managed to obtain French textbooks. A few French syllabaries and readers, geography and mathematics books appeared in the schools in the 1860s.

C brought an application, in French, against the City of Saint John.  The City and the Attorney General of New Brunswick moved to have the application struck.  The City’s pleadings were presented in English only.  The Attorney General’s pleadings were in French, but some citations were in English.  C objected to receiving pleadings in English on the basis that s. 22 of the Official Languages Act (“OLA”) of New Brunswick enacted in 2002 applied to the City and required it to adopt the language of proceedings chosen by him.  Both the Court of Queen’s Bench and the Court of Appeal found that s. 22 of the OLA does not apply to municipalities and cities because that interpretation would create internal incoherence within the OLA.

Je m'étais un peu impliqué dans cette affaire, comme je me suis impliqué dans l'affaire des contraventions en Ontario. Les contraventions qui étaient dressées dans certains aéroports, à Mississauga notamment, étaient en anglais seulement.

You also mentioned legal recourse, namely the action taken by the mayors of the Acadian Peninsula against the Canadian Food Inspection Agency. I was involved to some extent in that case, just as I got involved in the traffic ticket case in Ontario. The tickets for traffic violations that were handed out at certain airports, such as Mississauga, were in English only. I opposed that, invoking the fact that airports were federal land, and consequently, that the Official Languages Act should be applied. We took the case to court, and we won. The Province of Ontario did not challenge the court decision; it did not appeal the decision.
