There is universal agreement that physicians must not participate in executions because such participation is incompatible with the physician's role as healer. The use of a physician's knowledge and clinical skill for purposes other than promoting health, wellbeing and welfare undermines a basic ethical foundation of medicine---first, do no harm.

Proof of the mental element of advertence to the risk or wilful blindness to the risk will not undermine the policy objectives of s. 202.  The subjective test would at most offer protection for those who due to some peculiarity or unexpected accident commit conduct which, although wanton or reckless with respect to the lives and safety of others, can be explained as inconsistent with any degree of awareness of or wilful blindness to such a risk.

As we all know, Belgium is a country of SMEs, and in these difficult economic times, SMEs need extra support. To encourage SMEs in their investment policies, the legislature has dusted off the standard investment deduction for company tax, which has been frozen since 2007. For 2014 and 2015 investments, a temporary investment deduction of 4% was introduced. Because the standard investment deduction cannot be combined with the deduction for risk capital, and because of the low deduction percentage, the former was not often used.

The diplomatic result of these circumstances was, as you would expect, a compromise among the various concerns of states at that time. The nuclear non-proliferation treaty, NPT, which was signed in 1968 and which entered into force in 1970, enshrines a tripartite bargain among the five nuclear weapon states—the U.S., U.K., France, Russia, China—and all the other states parties.

The UAE lacks the military capability to defend itself in a conventional interstate conflict. Diverging priorities for GCC members, along with the GCC's minimal collective combat experience, will ensure the United States remains a considerably more important security guarantor for the UAE than other Gulf states. Interstate war risk in the Gulf has increased to moderate given the United States' more aggressive posture against Iran. Despite the decline in Iranian naval harassment of US and Arab Gulf naval vessels, there is an elevated risk of contained naval incidents near undemarcated waters with the UAE. Escalation into a broader conflict is unlikely and contingent on US support.

RCWU believes the conflict is due to the intent of the management to introduce some unpopular decisions including removal of compensatory payments for harmful working conditions, as well as shift from five to four-team based schedule of work, meaning new redundancies and increased working hours for the remaining workers. RCWU would never agree to the proposal while “yellow” union is certainly easier to manipulate.

In T 643/01 the appellant (patent proprietor) contended in particular that the opponent's reply of 28 January 2002 was inadmissible on the ground that it had been signed by Mr R., who was a legal practitioner and member of the Paris Bar but who was allegedly unable to show that he possessed an authorisation conforming to the requirements of R. 101(1) EPC 1973. The appellant requested that, if the signatory concerned was relying on his official status as a professional representative before the EPO, the board should find that French law prohibited such a plurality of offices, since the exercise of the profession of barrister could not properly be combined simultaneously with that of industrial property attorney. In the appellant's view, these provisions should be transposed into the law of the EPC. The board held, in the case at issue, that the signatory of the impugned pleadings of 28 January 2002 was entitled to act before the EPO and held the appropriate authorisation for that purpose. Mr R. and Mr D., legal practitioners and members of a partnership, were indeed members of the Paris Bar, and the names of both appeared on the list of professional representatives before the EPO. They were therefore both entitled to act in one capacity or the other before the EPO under Art. 134(1) and (7) EPC 1973. The board held that a decision on the legality, in France, of simultaneously exercising the profession of barrister and acting as a professional representative before the EPO fell solely within the jurisdiction of French professional and judicial bodies.

In argument, counsel for the appellant submitted that the respondent's reliance on purchase orders as evidence of the date of sale may have been, in part, attributable to the respondent's view that Trade Winds was a principal, not an agent, in these transactions. Counsel suggested that the "Buying Agent Agreement" and the testimony of Mr. Rosenbloom confirmed that Trade Winds acted as an agent. Counsel also noted that the respondent's witness stated that confirmation orders were not customary in these transactions, consistent with the appellant's version of how these transactions functioned. Further, counsel submitted that the evidence showed no attempt by the respondent to analyze the steps in these transactions to show why the date of the purchase orders is the same as the date of sale. Counsel stated that the respondent was, in effect, treating the offers by the appellant's agent as if they were an irrevocable tender or a unilateral contract, either of which was inconsistent with Mr. Rosenbloom's testimony that the appellant (and the factory) could cancel the order up to the time that production commenced. Counsel submitted that an offer does not become an agreement until acceptance is manifest. He subsequently referred to legal texts on the law of contracts to support this submission. Counsel also observed that, if the Tribunal used the date of production or the date of receipt by the appellant's freight forwarder as the date of sale, it would, therefore, have to be convinced that one or the other of these dates reflected a clear intention on the part of the factory to accept the order.
