The alleged hypnotic state is said to be characterized by heightened suggestibility. Hypnosis is used in behavior modification treatment for people who are trying to quit smoking, lose weight, overcome their fear of flying or break other undesirable habits. Some psychologists believe that the hypnotized person is not in a trance but in a self-induced state of suggestibility involving psyching oneself up and conforming to social expectations. There is little scientific evidence that there is a unique brain state for hypnosis which would support the notion that hypnosis is a unique state of consciousness.

In T 12/81 (OJ 1982, 296, see above) the board stated that it is permissible to make the definition of a chemical substance more precise by additional product parameters such as melting point, hydrophilic properties, NMR coupling constant or product-by-process claims if it cannot be defined by a sufficiently accurate generic formula. From this it necessarily follows that patent documents using such definitions will be prejudicial to the novelty of later applications claiming the same substance defined in a different and perhaps more precise way.

While exploring individuals/features matrices in an OMICS framework, it is interesting to examine how correlated features (i.e. genes, proteins, metabolites) correspond to similar individuals (i.e. samples). For example, a cluster of diseased kidney tissue samples may be characterized by a high expression of a group of genes, compared to other samples. The heat map tool in XLSTAT allows performing such explorations.

The first area is the international environment, and quite a bit has already been said on that, so I will be very brief. The current international environment can be characterized by a set of frequent, complex, and interdependent challenges generating humanitarian crises with multiple dimensions. Contributing factors include the lingering impacts of the food, energy, and economic crises, the effects of climate change and the effects of environmental degradation, and the persistence of civil conflict undermining security and the rule of law.

Afghanistan remains a country devastated by more than three decades of conflict. During the period from 2001 and 2016, the Government of Canada has invested approximately $2.8 billion in reconstruction and stabilisation efforts in Afghanistan, of which close to $2.2 billion has been disbursed for development assistance. Canada is also the 9th largest single-country donor providing humanitarian assistance to Afghanistan. While important progress has been made on a number of social, development and economic indicators, Afghanistan remains one of the world’s least developed, poorest and most fragile states, and continues to be characterized by pervasive human rights abuses, conflict and violence. Canada recognizes that in Afghanistan, time is needed for societal changes that result in protecting and upholding human rights, particularly for women and girls, and understands that given Afghanistan’s low level of development and the ongoing conflict, realizing sustainable development results is a long-term endeavor.

Child marriages continue to be prevalent in Saudi Arabia despite clear evidence that such marriages have severe negative physical, emotional, psychological, intellectual and sexual implications on children. Child marriage violates the human rights of girls by excluding them from decisions regarding the timing of marriage and choice of spouse. It may mark an abrupt initiation into sexual relations, often with a husband who is considerably older and a relative stranger. Premature pregnancy carries significant health risks and pregnancy-related deaths are the leading cause of death for girls aged 15-19 years worldwide. Early marriage also jeopardizes girls’ right to education. In addition, married girls have few social connections, restricted mobility, limited control over resources, and little power in their new households, and studies by UNICEF have found domestic violence to be common in child marriages.

Test environment evaluation has become an increasingly important issue in plant breeding. In the context of indirect selection, a test environment can be characterized by two parameters: the heritability in the test environment and its genetic correlation with the target environment. In the context of GGE biplot analysis, a test environment is similarly characterized by two parameters: its discrimination power and its similarity with other environments. This paper investigates the relationships between GGE biplots based on different data scaling methods and the theory of indirect selection, and introduces a heritability-adjusted (HA) GGE biplot. We demonstrate that the vector length of an environment in the HA-GGE biplot approximates the square root heritability (√H) within the environment and that the cosine of the angle between the vectors of two environments approximates the genetic correlation (r) between them. Moreover, projections of vectors of test environments onto that of a target environment approximate values of r√H, which are proportional to the predicted genetic gain expected in the target environment from indirect selection in the test environments at constant selection intensity. Thus, the HA-GGE biplot graphically displays the relative utility of environments in terms of selection response. Therefore, the HA-GGE biplot is the preferred GGE biplot for test environment evaluation. It is also the appropriate GGE biplot for genotype evaluation because it weights information from the different environments proportional to their within-environment square root heritability. Approximation of the HA-GGE biplot by other types of GGE biplots was discussed.

There are many good reasons why governments intervene in the economy and why such intervention needs to continue even while trade is being opened. The production or consumption of a good may generate pollution (an environmental externality) as a by-product. The market for a good or service may be characterized by information asymmetry, with sellers being more informed about the quality or safety of their product than buyers. Firms may be restricting competition by colluding or abusing their dominant position. There may be moral hazard, i.e. excessive risk taking, in the banking system because of the existence of deposit insurance. In all these cases, regulations may form part of the public policy response to the underlying market failures. Moreover, there are very legitimate distributional reasons for governments to intervene in markets with a view, for example, to improving poor people's access to public services or to ensure equitable access to such services across all regions of a country. WTO rules do not constrain governments' ability to pursue such regulatory objectives.

In this latter regard, the navy will need to become increasingly pro-active and flexible in its recruitment strategy. To address the future "human investor", any 2020 HR policy must be focussed on ensuring employees receive (as a minimum) for their investment of skills all of the following: intrinsic fulfilment; growth opportunities; financial rewards; and service recognition. An HR strategy centred solely on the requirements of the new "human investor", however, is doomed to failure. A successful strategy must also be focussed on providing the organisation with the "right" individuals for the jobs at hand. In the navy of 2020, this will be a work force capable of adapting fully to an increasingly complex and rapidly changing environment; a work force characterised by its ability to process vast amounts of information quickly, and to make informed decisions when faced with a high operational tempo. The "right" individuals will be those with strong systemic awareness, and innovative and decisive characters. The emphasis for our future navy must be on attracting individuals of this quality, rather than simply focussing on the quantity of personnel needed to fulfil vacant billets.

72.                     It is true, of course, that we are not invited to create a general environmental pollution power but one restricted to ocean pollution. But it seems to me that the same considerations apply. I shall, however, attempt to look at it in terms of the qualities or attributes that are said to mark the subjects that have been held to fall within the peace, order and good government clause as being matters of national concern. Such a subject, it has been said, must be marked by a singleness, distinctiveness and indivisibility that clearly distinguishes it from matters of provincial concern. In my view, ocean pollution fails to meet this test for a variety of reasons. In addition to those applicable to environmental pollution generally, the following specific difficulties may be noted. First of all, marine waters are not wholly bounded by the coast; in many areas, they extend upstream into rivers for many miles. The application of the Act appears to be restricted to waters beyond the mouths of rivers (and so intrude less on provincial powers), but this is not entirely clear, and if it is so restricted, it is not clear whether this distinction is based on convenience or constitutional imperative. Apart from this, the line between salt and fresh water cannot be demarcated clearly; it is different at different depths of water, changes with the season and shifts constantly; see U.N. Report, op. cit., at p. 12. In any event, it is not so much the waters, whether fresh or salt, with which we are concerned, but their pollution. And the pollution of marine water is contributed to by the vast amounts of effluents that are poured or seep into fresh waters everywhere (id., at p. 13). There is a constant intermixture of waters; fresh waters flow into the sea and marine waters penetrate deeply inland at high tide only to return to the sea laden with pollutants collected during their incursion inland. Nor is the pollution of the ocean confined to pollution emanating from substances deposited in water. In important respects, the pollution of the sea results from emissions into the air, which are then transported over many miles and deposited into the sea; see id., at p. 15; I.J.C. Report, op. cit., at p. 22. I cannot, therefore, see ocean pollution as a sufficiently discrete subject upon which to found the kind of legislative power sought here. It is an attempt to create a federal pollution control power on unclear geographical grounds and limited to part
