Judge Shahabuddeen determined that the Court must confine itself to sources which speak with authority. He referred, in particular, to United Nations General Assembly (UNGA) resolutions. There have been a whole series of UNGA resolutions condemning the use of nuclear weapons. For example, UNGA resolution 38/75 (15 December 1983) states that the General Assembly " resolutely, unconditionally and for all time condemns nuclear war as being contrary to human conscience and reason... " Neither t his nor other resolutions were adopted unanimously and so are unlikely to reflect the existence of a customary norm de lege lata . However, such resolutions do provide evidence of the public conscience [19 ] . Judge Shahabuddeen concluded that the public conscience, as found for example in UNGA resolutions, could be viewed to oppose the use of nuclear weapons as unacceptable in all circumstances.

According to the authors, intelligence-led policing (ILP) lacks long-term effectiveness in addressing TOC because it often focuses on “recidivist offenders” and groups, diffusing criminal opportunities, and the structures that allow patterns of criminal offending to become entrenched (73). In standard ILP, the approach typically centers analysis on an individual criminal, leaving aside the proactive strategy that deals with the environment in which conflicts between non-state actors and law enforcement take place. The authors argue that the current ILP does not put enough focus on examining areas where broader strategic opportunities are more likely to be realized.

It is also worth noting that all programs initiated during this period included a results-based framework or the equivalent, making it possible to measure progress toward achieving results on an interim basis, or at least to allow for informed reflection in case the expected results had not materialized.

A number of members, developing countries in particular, say the agreement is too vague on some points. They want to see this tightened through a ministerial declaration or some other means. They would also like some voluntary commitments turned into mandatory ones.

To better assess TOC and law enforcement reaction to it, this research suggests that police have three major roles: 1) produce threat assessments; 2) act as global police; and 3) increase police capability worldwide (72). Within these roles, the authors indicate that when police develop quantitative analyses of TOC threats, the intelligence information is too imprecise to be useful for strategic decision-making.

The criticism of the present state of the law which is the springboard for the desire to change it is largely based on the fact that the term "inevitable consequences" is too vague and uncertain.  That term is the expression of the factual conclusion that the necessary causal connection exists between the work authorized and the nuisance.  If the necessary connection exists, then it follows that the legislature authorized that which is the inevitable consequence of the work described in the statute.

, 3rd ed. (London: Butterworths, 1995) at 124 states that "social well-being was not a purpose within the spirit and intendment of the preamble to the Statute of Elizabeth I: the concept was too vague"). However, organizing a social event may be acceptable if it supports a charitable purpose, and is clearly incidental to that purpose. Examples include: when one of the activities of a group set up to provide settlement assistance to refugees is to hold occasional social functions for their clients; or when a religious institution organizes a social activity for its members.

Participants in the consultation process support FCAC's change in approach to require FRFIs to self-report to FCAC all compliance matters that have reached an approved level, whether the compliance issue was determined as a result of a consumer complaint or not. The new reportable standard was described in the definition of a "reportable compliance matter." This definition allows the inclusion of major compliance deficiencies found by FRFIs through normal review to be reported to FCAC, as well as reportable consumer complaints.

1.1. FAIR Canada would have preferred if OBSI was at this stage putting out revised Terms of Reference (“TOR”) that incorporated its ability to bind Participating Firms if the Complainant accepted the OBSI recommendation. The approach taken will require two consultations rather than one. It will also inevitably lead stakeholders to advocate for substantive changes beyond the exercise being contemplated at the current time.

And book rooms. If it's so loosey-goosey as “Let's meet whenever we can meet”, in all fairness to the way things are run on the Hill here, that would not be very orderly.

One medium-term step to incorporating universal design principles into the videoconferencing portion of a tribunal’s work is to examine the enabling legislation under which videoconferencing operates within a specific adjudicative context. This is important because legislation and rules provide the framework for allowing and limiting its use. Where the statute or provision that is to be interpreted is too vague, there is always a risk that the decision maker will interpret the provision in a way that benefits the majority non-disabled group, while perhaps not being aware that the interpretation may have placed a limitation on persons with disabilities. For example, this could occur if a tribunal imposed a videoconference hearing on a party, where the rules of a tribunal allow, whose personal adaptive technology was not compatible with the conferencing equipment. On the other hand, where the statute or provision governing videoconferencing is too specific, it can limit the ability of the decision maker to adapt the tribunal’s process to the needs of litigants even where there is an agreed need for accommodation. Videoconferencing is sometimes allowed under tribunal rules for some types of hearing but not others, even where it may be useful for the types of hearings where it is restricted. For example, now-repealed rules of the Canada Agricultural Review Tribunal allowed the Tribunal to meet by teleconference for all purposes except for conducting hearings, while recently amended rules allow hearings at the discretion of the Tribunal for any reason. Tribunals should therefore be aware that the rules under which they operate can have differential impacts, and when these are changed, this should be done with a view to accessibility at an early stage.
