In my view this appeal does not give rise to any question of a principle of law. It is a case which depends upon its own special facts.

I have to caution everybody that hypothetical questions have their own set of facts. The matter about which we are appearing before the committee has its own set of facts. Two plus two doesn't equal five. If you take facts from a hypothetical case and try to apply it to a specific case, you may not come out with the same results.

The phrase "through which the particular person makes supplies" requires that the activity at the fixed place of business of a person be an essential and significant part of the particular overall business activity of the person. There must be a large degree of involvement through the fixed place of business in making or facilitating supplies by the person. There is no specific set of circumstances that must exist. Rather, each case will be determined on its own facts.

In J 15/86 (OJ 1988, 417) the board stated that there was a recognised difference between passive abandonment and active withdrawal of a European patent application. Each case in which there was a dispute as to the applicant's intention had to be considered on its own facts. A written statement by the applicant or his representative had to be interpreted in the context of the document as a whole and the surrounding circumstances. Similarly, J 7/87 (OJ 1988, 422) ruled that the language used had to be interpreted in the light of the surrounding circumstances, from which it had to be clear that the applicant really wanted immediate and unconditional withdrawal rather than passive abandonment leading in the course of time to deemed withdrawal. Actual withdrawal did not depend on whether the applicant had used the term "withdrawal".

While there is no “one size fits all approach” to the form or content of an objection notice[6] and each case must be reviewed on its own facts, there is nonetheless a requirement that an objection be made. It is up to the Tribunal to determine whether the form and content of the objection is sufficient. On the basis of the facts of this matter, the Tribunal finds that it was reasonable for PWGSC to believe that no further action was required after having received Mr. Reeves’ “thank you” response, which did not include any qualifications or objections regarding the minimum dimension requirement or the CSA certification requirement. The Tribunal further finds that Mr. Reeves’ response cannot somehow serve to keep the complaint alive.
