As a result, the legislation that does exist is uneven, and has a negative impact on citizens’ communication rights (for instance, in the area of a citizen’s right to receive information, to prevent the circulation of defamatory information, or to protect intellectual property). 53 I appreciate, of course, that “universalism” will not work if every jurisdiction only defers to the law of the primary bankruptcy where that law coincides precisely with the domestic law of the deferring court.  The fact remains, however, that Canadian public policy, expressed through the Act, strongly supports the rights of claimants whom we would regard as secured creditors.  Our law considers it in the interests of commercial activity generally that secured rights be protected.  It seems to me that MacKay J. correctly regarded Holt as a “secured creditor” in bankruptcy terms, and in the exercise of his discretion under s. 50 of the Federal Court Act, he was entirely justified in putting considerable weight on that factor.

Fait intéressant, l'accord élimine presque entièrement l'accès du gouvernement colombien à des mesures de protection des revenus et du gagne-pain des agriculteurs. Based on Colombian analysis, the Canadian FTA would likely have a very negative impact on production and jobs in Colombia, undermining, for example, the livelihoods of about 12,000 local wheat farmers and possibly eliminating up to 39,000 jobs in the informal pork sector. The crucial role of the Social Partners should be recognised in this process.
