There was an article in the North Island Gazette about the record pink return. One of the things it pointed to, and I'm sure you're aware of it, was the predicted demise of the pinks by 2011 because of fish farms. They have increased the number of sea lice, which, in turn, have threatened juvenile salmon. The study concluded that sea lice typically kill over 80% of the fish in each salmon run, and if sea lice infestations were to continue, affected pink salmon populations would collapse by 99%. Obviously, the article goes on to say, because of the positive returns, this hasn't happened.

It was about Ontario's Teacher Learning and Leadership Program, and I quote Anne: she said “the program is dazzling.” Linda Darling-Hammond is the faculty co-lead, and my new boss, and her new book is just out – “The Flat World” — and I read through it, and there is Ontario as an example of lateral capacity building through networks of schools, and sharing of good practice, and respect for teacher professionalism. The second week on the job, I received Michael Fullan's new book — now you all know Michael has been an advocate of Ontario for a very, very long time, but his new book is extremely direct in being clear in what the US has got wrong, and what Ontario has got right. So know that you are not getting rid of me completely — we will remain interconnected and connected, and I will champion, celebrate, and spread the word about this wonderful province and your amazing work.

The other main cause of contention was the court’s mandate to enforce the navigation acts. With respect to the colonies, the prime object of the legislation was to confine all transportation connected with them to British shipping and so ensure that the benefits derived fell to the mother country. Because of their slow economic development, the Maritime provinces had come to depend heavily on their neighbour to the south for supplies by the beginning of the 19th century; they therefore demanded some modification of the acts in order to obtain by legal means from the United States desperately needed staples and products for re-export to other British possessions. The lieutenant governors of the provinces fatalistically accepted a certain amount of clandestine trade as natural and unavoidable, and objected that too much preventive legislation would only obstruct “the quiet current of commercial industry.” Accordingly, breaches were made in the system as Sir John Wentworth*, Sir George Prevost*, Sir John Coape Sherbrooke*, and others took advantage of emergency powers to meet the needs of the colonists.

32 A leading case in relation to the first line of authority is In re Montagu’s Settlement Trusts, [1987] 1 Ch. 264. That case involved a dispute arising out of a 1923 settlement in which the future tenth Duke of Manchester had made an assignment of certain chattels to a number of trustees. The trustees were under a fiduciary duty to select and make an inventory of the chattels after the ninth Duke of Manchester died. The selection and inventory did not occur and the tenth Duke took absolutely whatever chattels he wanted. Megarry V.-C. held that the Duke was not liable as a constructive trustee because he did not know that the chattels were subject to a trust. In discussing the degree of knowledge required of the Duke, Megarry V.-C. emphasized that liability in “knowing receipt” cases is personal in nature and arises only if the stranger’s conscience is sufficiently affected to justify imposing a constructive trust. Although cases involving actual knowledge, recklessness, and wilful blindness justify imposing a constructive trust, Megarry V.-C. doubted, at p. 285, whether the carelessness associated with constructive knowledge cases could sufficiently bind the stranger’s conscience.
