Prof. Sugunasiri’s presentation entitled, “Charter Dialogues, Crucial Deference and their Import for Breaches of Part VII of the Official Languages Act,” considered how the Supreme Court of Canada’s dialogue and deference jurisprudence might impact on actual or apprehended breaches of this part of the Act. In particular, his presentation explored how these contextual constitutional variables could best inform advisory, legal risk management, and litigation approaches to the newly juticiable positive duties contained in section 41 of the Act.
