The Queen, supra, affords an example of provisions of a federal statute other than the Criminal Code which were found to have created a truly criminal offence, but in the present case, to paraphrase the language used by the majority of this Court in the Beaver case, I can discern little similarity between a statute designed, by forbidding the possession of undersized lobsters to protect the lobster industry, and a statute making it a serious crime to possess or deal in narcotics.
