If I were a criminal lawyer and had to defend a client, I would really like these sections, either way. Once the trial was underway, I could say that these sections pose major problems and do not adequately limit police powers. I would attack the credibility of the police officer who committed the act under these sections -- in other words, the very constitutionality of the regime. I would say there are so few conditions laid out in these sections that just about anything goes, and that that is unconstitutional.

En outre, le Tribunal est d'avis que les articles en question, pour être visés par l'exemption prévue à l'article 2, doivent contenir des marchandises exemptes de taxe au moment de la vente, et ne pas être vendus vides.
HELD: The appeal is dismissed. The Tribunal is of the view that paragraph 2(k) of Part I of Schedule III to the Excise Tax Act must be interpreted with reference to other paragraphs of section 2, to the remainder of Part I of Schedule III and to the purpose of the Excise Tax Act. In this regard, the containers described in paragraphs (a) to (j) of section 2 are used in the food industry in producing and packaging tax-exempt goods. Paragraph 2(k), in the context of section 2 as a whole and as an element of Part 1 of Schedule III, is clearly meant to be read in a commercial context. Further, the Tribunal is of the view that, to come within the exemptions in section 2, the items in question must contain tax - exempt goods at the time of sale and not be sold empty. If the appeal does not fail solely on the basis of statutory interpretation, it must fail on the basis of the facts. The appellant did not bring conclusive evidence that thermos bottles are "usual" containers for tax-exempt food or drink, or that they are used "exclusively" for this purpose.

Les articles en question, que le juge Scott a jugés obscènes dans le procès de novo, peuvent être décrits comme des stimulants erotiques. Ils sont nombreux et variés: on en a d’ailleurs déposé 70 à titre de pièces à conviction.
The articles alleged to be obscene in this case, and so found by Judge Scott on the trial de novo, may comprehensively be called sex devices or sex stimulators. They embraced a wide range, as indicated by the fact that more than seventy were filed as exhibits. Some had been displayed in the accused’s shop window where they were accompanied by a framed written description of their character and use. Catalogues showing these items and containing identical descriptions in respect of the items in the shop window were among the exhibits at the trial de novo. It does not appear, however, that the catalogues themselves were the subject of the charge on which the accused was convicted. Judge Scott divided the articles into two groups and found those in one group obscene and those in the second group not obscene. What is important in this case is not an examination and assessment of the articles put by the trial judge into the one group or the other, but rather whether he and the Court of Appeal erred in applying to those articles the test of obscenity found in s. 159(8) of the Criminal Code. In approaching this question, I put to one side (because there was no issue raised on these points) the question of possession and the fact that distribution of the articles was contemplated by the accused; nor was there any claim in this Court of the defence of public good, within s. 159(3)(4).
